Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That notwithstanding any indications as to those matters which may have been given in the application, no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs of the buildings.
Reason: To ensure that the details of the development are satisfactory.
That the existing dwelling on the site shall be demolished within 1 month of the occupation of the replacement dwelling hereby permitted and all the materials therefrom shall be removed from the site.
Reason: To accord with policy H16 of the Council's adopted South Oxfordshire Local Plan and to secure a satisfactory appearance.
That notwithstanding the provisions of Article 3 of, and Classes A, B, C and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, C and E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: That a dwelling of this size has been permitted on the basis of exceptional circumstances and a larger building would conflict with adopted policies.
That no development shall commence until a landfill gas risk assessment has been submitted to and approved in writing by the Local Planning Authority. Where a risk of migrating gas is identified, a scheme detailing appropriate works to mitigate the effects of gas shall be submitted to and approved in writing by the Local Planning Authority and such works shall be implemented prior to the first occupation of the dwelling.
Reason: To protect people on or near the site from the risks associated with migrating gas.
That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health and to avoid pollution.
