Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.

That samples of the materials to be used for all the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory and to accord with policies G8, CON10 and H4 of the Council's adopted South Oxfordshire Local Plan.

That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority. Thereafter the windows, external doors and rainwater goods shall be as approved. Reason: To ensure that the details of the development are satisfactory and to accord with policies G8, CON10 and H4 of the Council's adopted South Oxfordshire Local Plan.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing, screen walling and railings shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings and to accord with policy G9 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding any indications given in the application no work shall be carried out within 2 metres of the group of Lime trees protected by a Tree Preservation Order. All trees that are to be retained on the site shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing by the Local Planning Authority and to be implemented prior to the commencement of any development on the site. Reason: To safeguard trees which are visually important and to accord with policy C16 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding any indication given in the application no digging shall occur within 5 metres of the Lime trees protected by the Tree Preservation Order unless otherwise agreed in writing by the Local Planning Authority. Reason: To safeguard trees which are visually important and to accord with policy C16 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of the development details of the lighting for the private and public parking areas and access ways shall be submitted to and approved in writing. The lighting shall be carried out in accordance with the approved details. Reason: To ensure that the details of the development are satisfactory and to accord with policy G8 of the Council's adopted South Oxfordshire Local Plan.

That no development shall take place until plans showing the proposed slab levels of the buildings and proposed contours of the site has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall not proceed other than in accordance with the approved details. Reason: To ensure that the development has a satisfactory appearance and is not unneighbourly and to accord with policies G8, CON10 and H4 of the Council's adopted South Oxfordshire Local Plan.

That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the eastern or western elevations of the dwellings/flats other than those expressly authorised by this permission. Reason: To ensure that the development is not unneighbourly and to accord with policy H4 of the Council's adopted South Oxfordshire Local Plan.

That the private parking provision shall be constructed, surfaced and laid out as shown on drawing 599.01C, and thereafter retained and maintained and shall not be used for any other purpose other than the parking of motor vehicles. Reason: To protect local amenities and to accord with policies G8 and H4 of the Council's adopted South Oxfordshire Local Plan.

That, prior to the commencement of the development a scheme for the restricting of use of the private parking areas to residents and their guests shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the approved scheme shall be implemented prior to the first occupation of the dwellings and it shall be retained as such. Reason: To protect local amenities and to accord with policies G8 and H4 of the Council's adopted South Oxfordshire Local Plan.

That prior to the commencement of any other development to which this permission relates all means of access between the land and the highway shall be formed, laid out and constructed in such position and with such vision splays as shall be approved by, and in all respects to the satisfaction of, the Local Planning Authority. Reason: In the interests of highway safety and convenience and to accord with policies G10 and H4 of the Council's adopted South Oxfordshire Local Plan.

That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development. Reason: In the interests of highway safety and convenience and to accord with policies G10 and H4 of the Council's adopted South Oxfordshire Local Plan.

That none of the dwellings shall be occupied until works for the disposal of sewage have been provided on the site to serve the development hereby permitted, in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution and to accord with policy G7 of the Council's adopted South Oxfordshire Local Plan.

That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to accord with policy G7 of the Council's adopted South Oxfordshire Local Plan.

That all means of surface water drainage from roads, garages and parking areas shall be via deep seal gullies of a type and specification to be submitted to and approved by the Local Planning Authority prior to the commencement of the development. Reason: In the interests of public health and to avoid pollution and to accord with policy G7 of the Council's adopted South Oxfordshire Local Plan.

That, prior to the commencement of the development hereby approved, details of bin storage areas to serve the development shall be submitted to and approved in writing by the Local Planning Authority. The bin storage areas shall be provided prior to the occupation of the residential units hereby approved and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly and to accord with policies G8 and H4 of the Council's adopted South Oxfordshire Local Plan.
