Erection of 9 detached houses and 14 semi detached houses. New footpath link to Wheatley Footpath No. 2. (As amended by drawing nos. 275/5 Rev A, 275/7 Rev A, 275/8 Rev A, 275/12, and 275/13 received on 9 June 1998, and drawing no. 275/3 Rev M accompanying agent's letter dated 28 September 1998 and by drawing no. 275/LS/1G accompanying agent's letter dated 23 March 1999 and by Drg Nos. 275/LS-1K and 275/39 Rev A accompanying Agents letter dated 12 August 1999).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of all materials to be used in the external construction and
finishes of the development hereby permitted shall be submitted to and
approved in writing by the Local Planning Authority before the
development is commenced.
Reason: To safeguard the character of the area.
That a scheme for the landscaping of the site, including the planting of
live trees and shrubs, the treatment of the access road and hardstandings,
and the provision of boundary fencing and screen walling shall be
submitted to and approved in writing by the Local Planning Authority
prior to the commencement of the development hereby permitted. The
scheme shall be implemented as approved within 12 months of the
commencement of the approved development and thereafter be maintained in
accordance with the approved scheme to the complete satisfaction of the
Local Planning Authority. In the event of any of the trees or shrubs so
planted dying or being seriously damaged or destroyed within 3 years of
the completion of the development, a new tree or shrub or equivalent
number of trees or shrubs, as the case may be, of a species first
approved by the Local Planning Authority, be planted and properly
maintained in a position or positions first approved by the Local
Planning Authority.
Reason: To help to assimilate the development into its surroundings.
That details of surface water drainage works shall be submitted to and
approved in writing by the Local Planning Authority prior to the
development commencing.
Reason: In the interests of public health.
That development shall not begin until a scheme for the disposal of
foul sewage has been submitted to and approved in writing by the
Local Planning Authority.
Reason: In the interests of public health and to avoid pollution.
That the garage accommodation shall be retained as such and shall not be
adapted for living purposes unless planning permission has first been
granted by the Local Planning Authority on a formal application in
respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
Before the development is commenced a detailed site investigation shall
be carried out to establish if the site is contaminated, to assess the
degree and nature of the contamination present, and to determine its
potential for the pollution of the water environment. The method and
extent of this site investigation shall be agreed with the Planning
Authority prior to commencement of the work. Details of appropriate
measures to prevent pollution of groundwater and surface water,
including provisions for monitoring, shall then be submitted to and
approved in writing by the Local Planning Authority before development
commences. The development shall then proceed in strict accordance
with the measures approved.
Reason: To prevent pollution of the water environment.
That no dwelling shall be occupied until a footpath link which shall
be surfaced and lit, has been provided between the site access and
Littleworth Road, in accordance with details to be submitted to and
approved by the Local Planning Authority and Oxfordshire County Council
as Highway Authority.
Reason: In the interests of highway safety and convenience.
That work be not commenced on the erection of any dwellings until the
carriageways only serving the whole of that portion of the development
under construction, have been laid out and constructed to the above
mentioned specification, save for wearing course and kerbing.
Reason: In the interests of highway safety, to provide protection of the
subgrade and to ensure adequate clear running surfaces which will
protect adjoining public highways from droppings of spoil, mud,
etc.
That no dwelling shall be occupied until the whole of the roads and
footpaths shown on the layout plan accompanying the application, and all
surface water drainage works, have been laid out and constructed in
accordance with the Oxfordshire County Council Design Guide for
Residential Roads and the specification for the construction of works for
housing development.
Reason: In the interests of highway safety and convenience.
That the parking provision shall be as shown on the deposited drawing,
reference 275/3 Rev.E all constructed, surfaced and laid out, retained
and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
That no further means of access whatsoever be formed or used between the
land and the highway.
Reason: In the interests of highway safety and convenience.
That prior to the commencement of any development, the access and
associated highway improvements shall be formed in accordance with a
scheme to be submitted to and approved by the Local Planning Authority.
Reason: In the interest of highway safety and convenience.
That the area of public open space shall be resited to the approximate
area of plots 12 and 13 on plan 275/3 in accordance with details to be
submitted and agreed in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory.
