Conditions / Refusal Reasons
That notwithstanding any indications as to these matters which have been given in this application, no development shall be started on the construction of the Public House until full details of the following have been submitted to and approved in writing by the Local Planning Authority. the siting and layout of the Public House the plans and elevations of the Public House That application for the approval of the reserved matters referred to in Condition 1 above shall be made to the Local Planning Authority not later than three years from the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That the development to which this permission relates shall be begun not later than whichever is the later of the following dates; (a) the expiration of 5 years from the date of this permission; or (b) the expiration of 2 years from the final approval of the reserved matters, or, in the case of approval on different dates, the final approval of the last such matter to be approved. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings. That the parking areas shall be provided, surfaced, laid out and thereafter be kept available for the parking of motor vehicles in accordance with the parking schedule set out in the agent's letter dated 25 November 1996. Reason: In the interests of highway safety and convenience. That the bus shelters shown on drawing 94.57 10 Rev. H shall be provided prior to the first use of any unit on the site. Reason: To ensure that the details of the development are satisfactory. That full details of the method of fume extraction from the A3 uses shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the relevant unit. Reason: To protect local amenities. That all cycleways and links shown on the approved drawing, 94.57 10 Rev. H, shall be constructed prior to the first use of any unit. Reason: To ensure satisfactory comprehensive development. That prior to the commencement of its use the means of access to which this permission relates shall be formed, laid out and constructed strictly in accordance with the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That the vision splays shown on drawing 94.57 10 Rev H shall be provided prior to the first occupation of any building and shall thereafter be protected. Reason: In the interest of highway safety and convenience.
