Demolition of existing garage including workshops, canopy, former showroom with attached cottage/s known as Scotts House, formation of mews access, erection of 10 x 2 and 3 bedroom cottages and demolition of side outbuilding to Northdown and replacement with new attached single garage (as amended by agents' letter dated 4 September 1996 and accompanying drawing 96/CUX SP2A, as amplified by agents' letter dated 11 October 1996 and accompanying drawings 96/CUX EX1 and 3C96 and as amended by agents' letter dated 12 December 1996 and accompanying drawings 96/CUX SP1B, H2B, H3B and H5).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls, roofs
and boundary walls shall be submitted to and approved in writing by the
Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory.
That development shall not begin until a detailed specification of the
type, design and external finish of all windows, external doors, roof
vents and rainwater goods has been submitted to and approved in writing
by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory.
That the garage doors shall be constructed with vertical dark stained
timber boarding and shall thereafter be retained as such.
Reason: To ensure that the details of the development are satisfactory.
That except insofar as may be otherwise agreed in writing by the Local
Planning Authority, all trees, shrubs and hedges on the land shall be
retained and protected during the course of the development and for a
period of five years following the completion of the development. Any
trees, shrubs or plants which within that period die, are removed or
become seriously damaged or diseased, shall be replaced in the next
planting season with others of a similar size and species, unless the
Local Planning Authority gives written consent to any variation.
Reason: To safeguard the character of the area.
That the existing trees and hedges on the land shall be protected whilst
development operations are in progress, in accordance with a scheme to be
first agreed in writing with the Local Planning Authority and to be
implemented prior to the commencement of the development.
Reason: To safeguard the character of the area.
That a scheme for the landscaping of the site, including the planting
of live trees and shrubs, the treatment of the access road and
hardstandings, the provision of boundary fencing and screen walling,
and the layout of all underground servicing, shall be submitted to
and approved in writing by the Local Planning Authority prior to the
commencement of the development hereby permitted. The scheme shall be
implemented as approved within 12 months of the commencement of the
approved development and thereafter be maintained in accordance with
the approved scheme. In the event of any of the trees or shrubs so
planted dying or being seriously damaged or destroyed within 5 years
of the completion of the development, a new tree or shrub or equivalent
number of trees or shrubs, as the case may be, of a species first
approved by the Local Planning Authority, be planted and properly
maintained in a position or positions first approved by the Local
Planning Authority.
Reason: To help assimilate the development into its surroundings.
That notwithstanding anything contained in the Town and Country Planning
(General Permitted Development) Order 1995 (or any order revoking and
re-enacting that Order) no additional windows shall be constructed in
any elevations of the dwellings or garages.
Reason: To ensure that the development is not unneighbourly.
That prior to the commencement of the development a scheme for the
provision and future retention of the footpath link shall be submitted
to and approved in writing by the Local Planning Authority.
Reason: To ensure satisfactory comprehensive development.
That no development shall be carried out on the site unless an application
for planning permission in that behalf is first submitted to and approved
by the Local Planning Authority, and this condition shall apply
notwithstanding the provisions of the Town and Country Planning (General
Permitted Development) Order 1995.
Reason: To protect local amenities.
That the garage accommodation shall be retained as such and shall not be
adapted for living purposes unless planning permission has first been
granted by the Local Planning Authority on a formal application in
respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
That details of surface water drainage works shall be submitted to and
approved in writing by the Local Planning Authority prior to the
development commencing.
Reason: In the interests of public health.
That the whole of the roads and footpaths shown on the layout plan
accompanying the application, and all surface water drainage works, be
laid out and constructed in accordance with the Oxfordshire County
Council Design Guide for Residential Roads and the specification for the
construction of works for housing development.
Reason: In the interests of highway safety and convenience.
That work be not commenced on the erection of any dwellings until the
carriageways only serving the whole of that portion of the development
under construction, have been laid out and constructed to the above
mentioned specification, save for wearing course and kerbing.
Reason: In the interests of highway safety, to provide protection of the
subgrade and to ensure adequate clear running surfaces which will
protect adjoining public highways from droppings of spoil, mud,
etc.
That prior to the first occupation of any of the dwellings, a rumble
strip shall be provided at the entrance bellmouth in accordance with
a scheme which shall first be submitted to and approved in writing by
the Local Plannng Authority prior to the commencement of the development.
Reason: In the interests of highway safety and convenience
That no dwelling shall be occupied until space has been laid out within the
site for vehicles to be parked as shown on drawing no. 96/CUX SP1B;
and such parking space shall be retained thereafter.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
That, before the development is commenced, a detailed site investigation
shall be carried out to establish if the site is contaminated, to assess
the degree and nature of the contamination present, and to determine its
pollution of the water environment. The method and extent of this
investigation shall be agreed with the Local Planning Authority prior to
commencement of the work. Details of appropriate measures to prevent
pollution of groundwater and surface water, including provisions for
monitoring, shall then be submitted to and approved in writing by the Local
Planning Authority before the development commences. The development
shall then proceed in strict accordance with the measures approved.
Reason: To prevent pollution of the water environment.
