Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That the external walls and roofs shall be constructed and finished not in accordance with the specification of materials and finishes contained in the application, but in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That the development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority. Such specification shall include painted timber window frames. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That no residential unit shall be occupied until works for the disposal of foul sewage and surface water drainage have been provided in accordance with a scheme which shall first have been submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Reason: In the interests of public health and to avoid pollution. That, with the exception of the wardens accommodation, the occupation of the residential units shall be restricted to persons having attained a minimum age of 65 years old, unless otherwise agreed in writing by the Local Planning Authority. Reason: Because of the special circumstances resulting in a reduced parking provision. That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That the whole of the roads and footpaths shown on the layout plan S9/10/101B accompanying the application, and all surface water drainage works relating thereto, shall be laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development. Reason: In the interests of highway safety and convenience. That no residential unit shall be occupied until the whole of that portion of the roads referred to in Condition 9 which is to serve such residential unit except for the final surfacing thereof, and all surface water drainage works relating thereto have been laid out, constructed and completed in accordance with the Oxfordshire County Council specification for the construction of works for housing development. Reason: In the interests of highway safety and convenience. That no works shall commence on the erection of any residential unit until the carriageways only serving the whole of that portion of the development under construction have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing. Reason: In the interests of highway safety and convenience. That the existing boundary wall on the Greys Hill frontage shall be demolished and rebuilt in accordance with the details accompanying the application and plan S9/10/101B prior to development commencing on the residential units hereby permitted, unless the Local Planning Authority gives written consent to any variation. Reason: In the interests of highway safety and convenience. That no residential unit shall be occupied until the parking and turning spaces shown on the submitted layout plan No. S9/10 101B have been constructed and laid out; and such spaces shall thereafter be retained for these purposes. Reason: In the interest of highway safety and convenience.
