Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roof. Reason: To ensure that the details of the development are satisfactory. That until ten years from the date of their first occupation the buildings hereby permitted shall be occupied and used by Countax Ltd or by a person, firm, company or organisation which either:- a) does not occupy more than 500 square metres (gross) of floorspace; or b) was, immediately prior to occupying more than 500 metres (gross) of floorspace, in occupation for at least two years of premises within the Rural Areas Local Plan Area; or c) has, prior to occupying more than 500 square metres (gross) of floorspace, obtained written approval from the Local Planning Authority that their source of supply, commercial linkages, labour supply and markets make this specific location particularly suitable for them. Reason: To comply with the Local Planning Authority's employment policy. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development. Reason: To protect local amenities. That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings. That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution. That a detailed scheme of all surface water drainage works shall be submitted to and approved by the Local Planning Authority in writing before any development commences. The scheme shall make provision for surface water from roads and vehicle parking areas to be discharged via deep seal trapped gullies. Reason: In the interests of public health and to avoid pollution. That the open areas outside the building shall be used for the parking of vehicles, access, manoeuvring, loading and unloading purposes only. No storage, industrial or other business use shall take place other than inside the building. Reason: To protect local amenities. That the building hereby permitted shall not be occupied until a junction improvement incorporating a right-turn lane at the junction of Rectory Road and the A329 has been constructed in accordance with a detailed scheme which shall first have been submitted to and approved in writing by the Local Planning Authority after consultation with the County Surveyor and Engineer. Reason: In the interest of highway safety and convenience. That prior to the commencement of any other development to which this permission relates, the bellmouth radius on the western side of the existing access shall be increased to 15m. in accordance with details shown on Plan reference 9574/P7 in all respects to the satisfaction of the Local Planning Authority. Reason: In the interest of highway safety and convenience. That the building shall not be occupied until space has been laid out within the site for 50 cars and 10 service vehicles to be parked and for vehicles to turn so that they may enter and leave the site in a forward direction. Reason: To comply with the Local Planning Authority's approved standards. That the building shall be used only for the purpose specified in the application and for no other purpose whatsoever. Reason: To protect local amenities. That the storage warehouse shall not at any time incorporate a mezzanine floor unless planning permission has first been obtained from the Local Planning Authority. Reason: To secure the proper planning of the locality.
