Variation of condition 2 (Approved plans), 5 (Schedule of Materials), 6 (Glass coating for external glazing), 9 (Surface water drainage works), 10 (Foul drainage), 11 (Vision splay protection) and 13 (Biodiversity Mitigation and Enhancement Strategy) on application P22S2693/FUL(Redevelopment of site for two houses. Phase 1- demolition of existing structures and site clearance/preparation. Phase 2- erection of Plot 1
dwellinghouse and related works. Phase 3- erection of Plot 2 dwellinghouse and related works).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later 19th October 2025.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans:

except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That the development shall, unless otherwise agreed in writing beforehand with the Local Planning Authority (LPA), be carried out in phases as follows:
1. Demolition of the existing buildings on site and removal of associated hard surfaces and supporting
engineering works (other than those required for the development hereby permitted)
2. Construction of Plot 1
3. Construction of Plot 2
The developer(s) shall before commencing each phase notify the LPA of the date of commencement of each phase by exchange of letter/email.
Reason: To allow flexibility in delivering the scheme and opportunity for potential self-build or custom build dwellings.
The development must be implemented strictly in accordance with the contaminated land remediation strategy set out in the report approved under application ref: P22/S1859/DIS. Prior to first occupation of the development hereby approved, a verification report that demonstrates the effectiveness of the remediation carried out must be submitted to, and approved in writing by, the Local Planning Authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
Unless otherwise agreed in writing by the Local Planning Authority, the materials to be used in the external finishes of the development hereby approved shall be in accordance with the schedule of materials approved under discharge of conditions application ref: P22/S4198/DIS
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1,DES2 and ENV1 of the South Oxfordshire Local Plan 2035.
The external glazing for all windows on the south east (main road facing) elevation shall be implemented in accordance with the approved specification set out under discharge of condition application ref: P22/S4198/DIS. Thereafter, the glazing approved shall be installed and maintained in perpetuity in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies ENV1, and ENV12 of the South Oxfordshire Local Plan 2035.
The tree protection details as described within the submitted Tree Survey Report, Impact Appraisal, Tree Protection Details report shall be put in place prior to the commencement of each phase of development on site, including any works of demolition, and thereafter retained in situ for the duration of each phase of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
Prior to first occupation of each dwelling, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement hereby approved. Each Verification Report shall be submitted to the Local Planning Authority and approved in writing. Each Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.
The development shall be implemented fully in accordance with the surface water drainage scheme approved under discharge of condition application ref: P22/S4198/DIS. Any variation to the approved details must have prior written approval from the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies ENV12 and EP4 of the South Oxfordshire Local Plan 2035.
The development shall be implemented fully in accordance with the foul water drainage scheme approved under discharge of condition application ref: P22/S4198/DIS. Any variation to the approved details must have prior written approval from the Local Planning Authority.
Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
The vision splays shown on the approved plan (20041/206, Rev I) shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the final occupation of the development, all parking and turning areas within the site shall be provided in accordance with the approved site plan and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of each dwelling, the respective biodiversity enhancement features approved under discharge of condition application ref: P22/S4198/DIS shall be fully implemented. The features shall be retained thereafter.
Reason: To ensure that there is no net loss of biodiversity, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.
No external lighting shall be provided on site other than that which has first been permitted in accordance with a lighting scheme submitted to and approved in writing by the Local Planning Authority prior to the installation of any external lighting. Any external lighting provided shall be implemented only in accordance with the approved details and directed downwards to prevent undue light spread/spillage, and shall thereafter be retained as such.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
