An assessment of the available evidence, on the balance of probability, supports the conclusion that the outbuilding shown on drwgno LOC-001 and set out in the covering letter dated 13 June 2025 reference 4771 was substantially completed a period exceeding 4-years prior to the application date and before 25 April 2024. The development is therefore immune from enforcement action under section 171B(1) (as it existed on 24 April 2024) of the Town and Country Planning Act 1990 ('the Act') and Part 3 of The Planning Act 2008 (Commencement No. 8) and Levelling-up and Regeneration Act 2023 (Commencement No. 4 and Transitional Provisions) Regulations 2024, and must be regarded as lawful within the meaning of section 191 of the Act.
