Planning permission is granted for the removal of condition 4 of planning permission ref P83/N0457 because the condition does not meet the tests for conditions set out in paragraph 57 of the NPPF. The condition unduly restricts the use of the garage for purposes that may be regarded as ancillary or incidental to the residential use of the property, such as a home office where the main office is elsewhere. Any material change in the use of the garage building would automatically require planning permission in any event and the condition is no longer deemed reasonable or necessary.
