Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, FP307, EL401a, 300, 301a, 303, LP100, EL4001, FP304, FP305c, FP308, SE500, SP204, SP201, 302, FP306 and SP200, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of development, a full CCTV survey of the surface water and foul water drainage networks through to Thames Waters sewer shall be submitted to, and approved in writing by, the Local Planning Authority. The CCTV survey will demonstrate that the entirety of the surface water and foul water drainage systems have been surveyed and that there are no defects shown throughout the surface water and foul water drainage systems. Any defects found shall be rectified in accordance with a scheme to be approved in writing by the local planning authority prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Cycle parking facilities shall be provided prior to the occupation of the residential units, in accordance with details to be submitted to and approved in writing by the Local Planning Authority, prior to the commencement of development.
o Cycle parking provision to accord with Oxfordshire County Council standards requires two cycle parking spaces per bedroom, using 'Sheffield' type cycle stands at minimum 0.9m centres to be covered and secure
Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the occupation of any of the residential units hereby approved, the development shall be carried out in full accordance with the recommendations, mitigation measures, and specifications set out in the approved Noise Impact Assessment prepared by Clear Acoustic Design on 12 August 2025
This shall include:
Installation of double glazing with acoustic performance specifications meeting or exceeding the recommendations of the Noise Impact Assessment to ensure internal noise levels within the residential units comply with BS8233:2014 guidance.
Implementation of appropriate floor/ceiling sound insulation measures between the ground floor commercial unit and the residential units above, designed to achieve airborne and impact sound insulation performance in accordance with Approved Document E of the Building Regulations (or other higher standards if specified in the Noise Impact Assessment).
Post-construction sound testing shall be carried out by a suitably qualified acoustic consultant to confirm that the installed noise mitigation measures achieve the expected internal noise levels and sound insulation performance. The results of such testing, along with a compliance statement, shall be submitted to and approved in writing by the Local Planning Authority prior to the occupation of any residential unit.
Should the post-construction testing identify any failure to meet the required standards, further mitigation measures shall be implemented and retested until full compliance is demonstrated, to the satisfaction of the Local Planning Authority.
Reason: To safeguard the amenities of the occupiers of the proposed development in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
