The replacement of the post and wire fence by a close boarded fence fails to meet the requirements set out by Schedule 2, Part 2, Class A, Minor Operations, Gates, fences, walls etc and is not permitted development. While it is proposed to retain the existing concrete posts the replacement of the existing wooden rails and the introduction of vertical boards across the front of the fence, would go beyond what can reasonably be described as works of maintenance, improvement or alteration'. Given the extent of the proposed works, the proposal would be tantamount to the erection of a new fence which, being over 1m in height, does not fall within permitted development.
