Planning permission for the removal of the conditions is granted because a lawful development certificate under planning ref P23/S3290/LDE has established that the dwelling has been occupied for a period of more than 10 years in breach of the occupancy condition on application P74/N0507. It follows that the dwelling has also been occupied in breach of the occupancy condition on P55/M0270 for a period of more than 10 years . The occupation of the dwelling without compliance with these conditions is lawful and the conditions no longer serve a useful purpose and do not meet the all tests for conditions.
