The use of annex building on the balance of probability, has not been in single use as an independent unit of residential accommodation for a period of four years or more, prior to the point of the registration of this application, 11th February 2025. The residential use as shown on drawings: LOC001 and 2024_99_01 and 2024_99_01 is therefore not immune from any planning enforcement under sections 171B and 191 of the Town and Country Planning Act 1990.
The submitted evidence is not sufficiently precise and unambiguous to justify the grant of a certificate on the balance of probability. The use is therefore not considered lawful by virtue of Section 191 of the Town and Country Planning Act 1990 (as amended).
