Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1185-WWA-B1-02-DR-A-0107 P03, 1185-WWA-B1-03-DR-A-0108 P03, 5992-WANT-ICS-01-XX-DR-C-0200-S2 P02, 1053-WWA-Z0--XX-DR-A-0000 P01, 1053-WWA-Z0-XX-DR-A-0001 P02, 1185-WWA-A-EL-DR-A-0200 P01, 1185-WWA-A-EL-DR-A-0201 P01, 1185-WWA-A-EL-DR-A-0204 P04, 1185-WWA-A-EL-DR-A-0205 P02, 1185-WWA-B1-00-A-0100 P01, 1185-WWA-B1-00-DR-A-0105 P01, 1185-WWA-B1-01-DR-A-0106 P03 and 1185-WWA-B1-XX-A-0002 P03, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of development, with the exception of any demolition, a full surface water drainage scheme in accordance with the principles set out on drawing Drainage Design drwgno 5992-WANT-ICS-01-XX-DR-C-0200-S2 P02.pdf, shall be submitted to, and approved in writing by, the Local Planning Authority. The design of the surface water drainage system will be in accordance with the non-statutory technical standards for sustainable drainage systems, including details of soakage testing undertaken in accordance with BRE 365, levels, size, position and construction of drainage works. The drainage scheme shall be sized to accommodate a minimum of the worst case 1 in 30 year storm, with evidence to demonstrate that the site can accommodate the worst case 1:100 year storm + 40% Climate Change storm, without any flows exiting up to this storm event and any storage on site not causing a nuisance or flooding to property. The approved scheme shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved.
Cv values must be set at 0.95.
An exceedance plan must be provided.
The building must contain a bio retention/source control feature. This could be in the form of a rain water planter or rain water butt.
Full construction details of all surface water drainage components including hard standing areas, must be provided.
Drainage layout from RWP must be provided.
A manhole schedule must be provided.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
Prior to the occupation of any of the approved flats, a SUDS Compliance report prepared by an appropriately qualified Engineer must be submitted to and approved by the Local Planning Authority. This must suitably demonstrate that the sustainable drainage system has been installed and completed in accordance with the approved scheme (or detail any minor variations). This report should as a minimum cover the following;
1) Inclusion of as-built drawings,
2) Inspection details of key SUDS features such as flow controls, storage features and
volumes and critical linking features or pipework undertaken, with appropriate photographs
and evidence of inspections incorporated,
3) Details of any remediation works required following the initial inspection,
4) Evidence that that remedial works have been completed.
5) CCTV survey.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development, details (including specification, position, height, orientation) of a scheme of features to be provided for protected and priority species, shall be submitted to and approved in writing by the local planning authority. The scheme shall be designed in conjunction with a suitably qualified ecologist and bird/bat boxes on buildings shall be integrated into the fabric of the development. A minimum number of biodiversity enhancement features shall be provided onsite as follows: one integrated bird nest box for house sparrow Passer domesticus or swift Apus apus, and one integrated bat box. Thereafter, the development shall be implemented in accordance with the approved details. All features shall be provided prior to first use and shall be retained and maintained thereafter.
Reason: To secure biodiversity enhancements onsite, in accordance with Policy ENV2 of the South Oxfordshire Local Plan, The South and Vale Joint Design Guide and paragraphs 187d and 193d of the NPPF
Prior to the construction of the development hereby approved above slab level, details of cycle parking facilities shall be submitted to and approved in writing by the Local Planning Authority. The cycle parking shall be implemented prior to first use of the development and thereafter retained in accordance with the approved details.
Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to occupation of the development hereby permitted the proposed means of access onto Sherwood Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development vision splays measuring 2.0 metres by 2.0 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.6 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 1185 WW 00 XX DR A 0002 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The first floor bedroom and kitchen windows on the northern elevation serving Flat 4 of the development hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut up to 1.7 metres from internal floor level prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
