Description
The proposals involve removing existing play equipment on site and installing new play items and outdoor gym equipment as part of a circular play trail. The proposals seek to enhance the natural appearance and features of the site, whilst extending the existing play offer to make more of the available space. Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 12844-LUC-XX-XX-DR-L-0200-P02, 12844-LUC-XX-XX-DR-L-0001 P01, 12844-LUC-XX-XX-DR-L-0005 P01, 12844-LUC-XX-XX-DR-L-0010 P01, 12844-LUC-XX-XX-DR-L-0100 P01, 12844-LUC-XX-XX-DR-L-0401 P01, 12844-LUC-XX-XX-DR-L-0500 P01, 12844-LUC-XX-XX-DR-L-0637 P01, 12844-LUC-XX-XX-DR-L-0638 P01, 12844-LUC-XX-XX-DR-L-0600 P01, 12884-LUC-XX-XX-DR-L-0601 P01, 12884-LUC-XX-XX-DR-L-0610 P01, TCP-Blue Mountains OX10 0DZ-10.06.24-TCP and TPP-Blue Mountains-17-10-24, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The tree protection details as shown on the approved SES Preliminary Arboricultural Method Statement, Tree Protection Plan (ref: TPP/Blue Mountains/17/10/24) and Site Set Up Plan (ref:12844-LUC-XX-XX-DR-L-0500 P01) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented, and all created and/or enhanced habitats thereafter maintained, in accordance with the approved Habitat Management and Monitoring Plan (LUC, dated 23 May 2025) and associated Biodiversity Gain Plan. Following the completion* of development, all subsequent monitoring reports shall be submitted to, and approved in writing by, the Local Planning Authority, in accordance with the methodology and frequency specified in the approved HMMP. (*completion is taken to be when all establishing habitat creation and enhancement works, as set out in the approved HMMP, have been implemented successfully). REASON: To ensure the development delivers a Biodiversity Net Gain onsite (Policy ENV3 of the South Oxfordshire Local Plan, and in accordance with Schedule 7A of the Town and Country Planning Act 1990).

Following the implementation of the Habitat Management and Monitoring Plan (HMMP) referred to in condition 5, no use and/or occupation of the development shall take place until evidence confirming that the development is complete* has been submitted to, and approved in writing by, the Local Planning Authority. The date of completion shall be confirmed in that evidence. (*completion is taken to be when all establishing habitat creation and enhancement works, as set out in the approved HMMP, have been implemented successfully). REASON: To ensure the development delivers a Biodiversity Net Gain on site (Policy ENV3 of the South Oxfordshire Local Plan, and in accordance with Schedule 7A of the Town and Country Planning Act 1990)"

The development hereby approved shall be implemented in full accordance with the method statements for mitigating construction impacts on protected species (Nesting birds and hedgehog) set out in Section 4.22 and 4.23 to 4.27 of the Preliminary Ecological Appraisal report submitted with the application (LUC, dated May 2025) Any variation shall be agreed in writing by the Local Planning Authority before such change is made. REASON: To ensure adverse construction effects on protected species are avoided in line with Policy ENV2 of the South Oxfordshire Local Plan

No later than three months after the date of planning permission, details (including specification, position, height, orientation) of a bat box to be provided onsite, shall be submitted to and approved in writing by the local planning authority. The choice and siting of the bat box shall be advised by a suitably qualified ecologist. Thereafter, the development shall be implemented in accordance with the approved details and the feature shall be provided prior to first use and retained and maintained thereafter. REASON: To secure biodiversity enhancements onsite, in accordance with Policy ENV2 of the South Oxfordshire Local Plan, the South and Vale Joint Design Guide and paragraphs 187 and 193 of the NPPF
