Conditions / Refusal Reasons
The development hereby permitted shall begin no later than two years from the date of approval of the last of the reserved matters to be approved. Reason: By virtue of Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, FIgure 03 I, Figure 04 J, Figure 1 L, Figure 02 D, Figure 5 A, LOC-001, TGA.2647.TPP.002C, TGA.2647.TSP.001B, 3856-210H, 3856-211AB, 3856-215B, 3856-216, 3856-217, 3856-218, 3856-219A, 3856-220E, 3856-221A, 3856-222B, 3856-300, 3856-301, 3856-303 A, 7002-MJA-SW-XX-DR-C-003_P6, 7002-MJA-SW-XX-DR-C-004_P3, 7002-MJA-SW-XX-DR-C-005_P6, 7002-MJA-SW-XX-DR-C-050_P5, 7002-MJA-SW-XX-DR-C-100_P2, 7002-MJA-SW-XX-DR-C-500_P5 and 7002-MJA-SW-XX-DR-C-500_P6 R, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The steps set out in the approved Phased Programme of Works dated November 2024 shall be implemented prior to the construction of the residential element of the scheme and thereafter retained as approved. Reason: To ensure satisfactory comprehensive development in accordance with Policies CF4, DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

The CCTV cameras and signage shall be installed and operated as shown on approved plan 3856 303 Rev A prior to the construction of the development hereby approved above slab level and thereafter shall be retained in continuous operation. Reason: To reduce the likelihood of crime and antisocial behaviour in accordance with Policy DES1 of the South Oxfordshire Local Plan 2035.

No development above slab level shall take place until a photographic schedule of the specific materials to be used in the external construction and finishes of each of the plots of the development hereby permitted has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The first floor north-east facing windows in Plots 1, 3, 6, 8 and 9 and the first floor south-west facing windows in Plots 4, 5, 7, 8 and 9 hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight (or other means of opening to be first agreed in writing by the Local Planning Authority) prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings; Class F - Hardsurfacing in front of the dwellings, shall be undertaken without obtaining planning permission from the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition to safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report. Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.

The air source heat pumps hereby approved shall meet Microgeneration Installation Standard: MCS 020 to qualify as permitted development. If this MCS Certification cannot be met, the approved air source heat pumps shall be so installed, maintained, and operated so as to ensure that the rating noise level from the equipment does not exceed the background noise level at the boundary of the premises. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (2014) 'Method for rating industrial and commercial sound'. The measurement location shall be 1 metre from the facade of the nearest noise sensitive receptor. In the event of unacceptable noise or vibration being caused by the installed plant, machinery and equipment, the persons responsible/owner shall investigate and undertake works to resolve the problem to the satisfaction of the local planning authority. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.

The vision splays shown on the approved plan 7002-MJA-SW-XX-DR-C-005 P6 shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.6 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to occupation of any dwellings, the 'Existing Right of Way' as labelled on approved plan 3856 - 211 Rev AB, shall be constructed/improved, laid out, including a drop kerb and tactile paving where crossing the vehicular access, surfaced, lit and drained in accordance with Oxfordshire County Council's Specifications. Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development, in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

No building shall be occupied until the whole of the roads and footpaths shown on the approved plan 3856 - 211 Rev AB, and all surface water drainage works have been laid out, constructed and completed in accordance with a specification to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. Reason: In the interests of highway safety and convenience in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 3856 - 211 Rev AB and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the construction of the development hereby approved above slab level, details of cycle parking facilities shall be submitted to and approved in writing by the Local Planning Authority. The cycle parking shall be implemented prior to first use of the development and thereafter retained in accordance with the approved details. Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

No surface water from the development shall be discharged onto the adjoining highway. Reason: In the interests of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Any gates provided to the 'Dorian Centre' shall be set back a minimum of 5.0 metres from the edge of the access road and shall open inwards into the site. Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The landscaping scheme under the approved Landscape Maintenance and Management Plan (LMMP - Rev D) dated July 2025, incorporating details shown on the following plans: · 9947 Figure 01 Landscape Strategy Rev. L · 9947 Figure 02 Hard Landscape Plan Rev. E · 9947 Figure 03 Boundary Plan (Fencing) Rev. I · 9947 Figure 04 Planting Plan. Rev. J shall be implemented prior to the first occupation of the dwellings hereby approved and thereafter be maintained in accordance with the approved scheme for a minimum of 30 years after the completion of the development (issuing of a building control completion certificate) In the event of any of the soft landscaping so planted dying or being seriously damaged or destroyed within 30 years of the completion of the development, replacement planting, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The three Amelanchier (AM CA) to be planted within the parking areas for units 3, 6, 7, and 8 shall be planted prior to occupation of the dwellings hereby approved. The trees must be planted into site specific tree pits. The tree pits are to be a crated pit design that incorporates technology that will enable tree/s to successfully grow in hard surface environments. The pits must provide the significant quantities of growing medium required to allow the trees to become established and grow on to maturity, sustaining the trees in a healthy condition and allow for ease of maintenance. Details of the tree species and the tree pits shall be submitted to and approved in writing by the Local Planning Authority prior to the construction of development above slab level. In the event of any of the trees so planted dying or being seriously damaged or destroyed within 30 years of the completion of the development, a new tree of a species first approved by the Local Planning Authority, be planted and properly maintained. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The tree protection details as shown on the approved Arboricultural Impact Assessment TGA.2647.ArbImpactAssessmentC and Tree Protection Plan TGA.2647.TPP.002C dated 7th March 2025 shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The measures stated on the Ecological Enhancement Plan (drawing no: JGE00224 V03 June 2025) shall be fully provided onsite prior to final occupation of the development and in accordance with the following: - Bird boxes shall be installed at a height no less than three (3) metres above ground level, with a northern or eastern aspect, with clear flight access flight lines provided (e.g. no intervening or blocking vegetation). - Bat boxes shall be positioned has high as possible on relevant structures, but no less than three (3) metres above ground level. - Stag beetle loggery shall be created in line with guidance provided by the People's Trust for Endangered Species entitled 'How to build a log pyramid for stag beetles'. - Pollinator post shall be a pole-mounted wooden insect hotel. These measures shall be thereafter retained in situ as approved. Reason: To secure the delivery of ecological enhancements onsite, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 187 and 193 of the NPPF.
