The available evidence does, on the balance of probabilities, support the following conclusions: - The building identified as 'Crackpots' on the submitted plan (1370-20) has been used as a workshop falling within Use Class B2 of the Town and Country Planning Use Classes Order for a continuous period in excess of 10 years. - The buildings identified as 'The Beef Building' and 'The Old Dairy 1 & 2' on the submitted plan (1370-20) have, on the balance of probabilities, been used for a mixed sui-generis use combining a general industrial process with elements of storage and office (Class B2, B8 and Class E of the Town and Country Planning Use Classes Order) for a continuous period in excess of 10 years. The respective uses have continued since gaining immunity and therefore the lawful uses have not been lost. As such, the continued use of the land for such purposes is immune from any planning enforcement action under Section 171B of the Town and Country Planning Act 1990 (as amended) ('the Act') and therefore lawful within the meaning of Section 191 of the Act.
