Conditions / Refusal Reasons
The development would not accord with the distribution strategy for housing within the district as Tetsworth is a smaller village, with limited services and facilities. The proposal would represent a significant expansion of a smaller village and would result in the provision of housing in an unsustainable location where future residents would have poor access to sustainable modes of transport. As such, the proposal would not accord with the district's strategy for growth and necessary infrastructure, contrary to policies STRAT1, H1, H8, H16, TRANS4 and TRANS5 of the South Oxfordshire Local Plan 2035, policy TET1 of the Tetsworth Neighbourhood Development Plan 2035 and the provisions of the National Planning Policy Framework.
The proposed development would encroach into open land important to the landscape setting of Tetsworth and would have a significant adverse impact on the setting to the village. The site has a high degree of accessibility and visual amenity and the proposal would have an adverse impact on the recreational amenity of users of the footpaths within and around the site. The development would harm the rural character and appearance of the site and surrounding area and have an adverse impact on important views. As such, the proposed development would be contrary to policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035, policy TET4 of the Tetsworth Neighbourhood Development Plan 2035 and the provisions of the National Planning Policy Framework.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure affordable housing to meet the needs of the district. As such, the development would be contrary to policy H9 of the South Oxfordshire Local Plan 2035 and the provisions of the National Planning Policy Framework.
In the absence of a completed Section 106 legal agreement, the proposed development fails to secure infrastructure necessary to meet the needs of the development. As such, the proposal is contrary to Policies INF1, TRANS4, TRANS5, EP3 and CF5 of the South Oxfordshire Local Plan 2035 and the provisions of the National Planning Policy Framework.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure significant onsite enhancements for the purpose of biodiversity net gain. As such, the proposed development fails to accord with Article 37A of The Town and Country Planning (Development Management Procedure) (England) Order 2015 (as amended) and the provisions of the National Planning Policy Framework.
