Conditions / Refusal Reasons
The application proposes specialist housing for older people in a location that does not have inclusive access to public transport and local facilities. The site is not within a reasonable and attractive walking distance to essential services or amenities to enable future residents to access facilities by walking, other forms of transport or via public transport. The development would be detached from the existing residential development in Benson and would not be well integrated with the wider neighbourhood. As such, the proposed development is contrary to policies H1, H13 and TRANS5 of the South Oxfordshire Local Plan 2035, policy NP1 of the Benson Neighbourhood Plan Review 2022-2035 and the provisions of the National Planning Policy Framework.

The proposals would breach the existing, clearly defined, residential edge of Benson and introduce an intrusive development into the rural landscape outside of the settlement boundary. The amount and proposed height of the dwellings, insufficient details pertaining to ground levels, impact on views both in, out and across Benson and the countryside and the coalescence of Benson with Rokemarsh would negatively harm the landscape character. As such, the proposed development is contrary to policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035, Policies NP27, NP28 and NP29 of the Benson Neighbourhood Plan Review 2022-2035 and the provisions of the National Planning Policy Framework.

The proposed development fails to provide year-round usable, attractive public open space within the site or good access to alternative amenity space to suit the needs of future residents. As such, the proposal is contrary to policy DES5 of the South Oxfordshire Local Plan 2035, the Joint Design Guide and the provisions of the National Planning Policy Framework.

The application has not demonstrated that a surface and foul water drainage scheme, which would not cause adverse flood risk to the surround area, could be implemented for the site. As such, the proposal is contrary to policies EP4 and DES1 of the South Oxfordshire Local Plan 2035, policy NP30 of the Benson Neighbourhood Plan Review 2022-2035 and the provisions of the National Planning Policy Framework.

In the absence of a completed Section 106 legal agreement, the proposal fails to secure the on and off-site enhancements for the purpose of biodiversity net gain. As such, the proposed development is contrary to policy ENV3 of the South Oxfordshire Local Plan 2035, policy NP23 of the Benson Neighbourhood Plan Review 2022-2035, and the provisions of the National Planning Policy Framework, and fails to accord with Article 37A of The Town and Country Planning (Development Management Procedure) (England) Order 2015 (as amended).

In the absence of a completed Section 106 legal agreement, the proposed development fails to secure infrastructure necessary to meet the needs of the development. As such, the proposal is contrary to Policies INF1, TRANS4, TRANS5, and EP3 of the South Oxfordshire Local Plan 2035, policies NP1, NP10, NP23, NP25, NP30 of the Benson Neighbourhood Plan Review 2022-2035and the provisions of the National Planning Policy Framework.

The application proposes that the affordable units will comprise homes for discounted market sales. This tenure would not meet the affordable housing needs of the district. In the absence of a completed Section 106 legal agreement to secure an appropriate tenure mix and accessible housing, the proposed development is contrary to policies H9, H11 and DES1 of the South Oxfordshire Local Plan 2035, and the provisions of the National Planning Policy Framework.
