Retrospective application for front, rear and loft extensions to existing dwelling, and subdivision of extended dwelling into two separate dwellings. (As amended by plan received 30 November 2024 to demonstrate four parking spaces).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, P-24-180-003-A, P-24-180-004-A, P-24-180-005-A and P-24-180-001-B, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
Prior to first occupation of the dwellings hereby permitted the access, parking and turning area shall be provided in accordance with the submitted plan, drawing P24/180/001 Revision B, and thereafter shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to first use of the vehicular access, 2m x 2m pedestrian visibility splays at height of 0.6m shall be provided and thereafter retained as such without obstruction.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first use of the development hereby approved a scheme of cycle storage shall be submitted to and approved by the Local Planning Authority, and thereafter installed and retained as such.
Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to commencement any further development works, post-development clear-up works, and/or landscaping works that are still to be undertaken on the site, a Working Method Statement for great crested newt (GCN) shall be submitted to and approved in writing by the Local Planning Authority. This shall be produced by a suitably qualified ecologist and shall describe Reasonable Avoidance Measures to be employed during any additional development works, post-development clear-up works, and/or landscaping works still to be undertaken )in order to avoid impacts on any GCN that could be present on the site), including:
a) Appointment of an Ecological Clerk of Works, who will give a toolbox talk to all contractors at the outset of works;
b) Rules for siting and storage methods of building materials and site waste to minimise risks of GCN using them as temporary refugia (such as use of pallets for materials storage, avoidance of storage on grass and vegetated garden areas, and prompt removal of waste).
c) Procedure to be followed if a newt is discovered during works.
The approved Construction Method Statement shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details.
Reason: To avoid impacts on protected species during development works in accordance with the NPPF and local policy ENV2.
Prior to the occupation of the development, details of biodiversity enhancements, to include bird and bat boxes, tiles or bricks on and around the new buildings and native and wildlife friendly landscaping (including pollen-rich and fruit-bearing planting and gaps at the bases of fences to allow hedgehogs to traverse through the gardens), shall be submitted to and approved in writing by the council. The biodiversity enhancements shall thereafter be installed as approved. A brief letter report from the ecologist shall be submitted to the council within 6 months of the completion of the development, confirming that the enhancements have been installed, including a simple plan showing their location and photographs of the enhancements in situ.
Reason: To compensate for the loss of biodiversity onsite and incorporate biodiversity enhancements in and around developments in accordance with paragraph the NPPF and local policy ENV3.
Prior to any further works commencing in relation to the development hereby approved, a full surface water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The design of the surface water drainage system shall be in accordance with the non-statutory technical standards for sustainable drainage systems, including details of BRE 365 soakage testing, levels, size, position and construction of all drainage works. The drainage scheme shall be sized to accommodate a minimum of the worst case 1 in 30 year storm, with evidence to demonstrate that the site can accommodate the worst case 1:100 year storm + 40% Climate Change storm, without any flows exiting up to this storm event and any storage on site not causing a nuisance or flooding to property. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved.
Reason: To prevent pollution and flooding in accordance with Policies ENV12 and EP4 of the South Oxfordshire Local Plan 2035.
