Description
Demolition of an existing conservatory, the construction of a ground floor side extension and a part ground floor / part first floor rear extension, alterations to the fenestration and a reconfigured terrace.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 01ES, 01, 00 and 24-047-10, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall be implemented in accordance with the bat mitigation and compensation plan details given in section 6.1 of the bat activity survey report (Eco 360 Ltd, 2024) submitted with the application in all respects. All ecological mitigation and enhancement features shall be delivered on site prior to first use and retained as such thereafter. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. If/where this mitigation strategy conflicts with any European Protected Species Licence agreement, the provisions of the latter shall take precedence.
Reason: To protect roosting bats and prevent a biodiversity net loss in accordance with policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and the NPPF.
Prior to the commencement of the development above new slab level, details (including specification, position, height, orientation) of a scheme of biodiversity enhancements to be provided, shall be submitted to and approved in writing by the local planning authority. A minimum of two bird and /or bat boxes, tiles or bricks (in addition to the compensatory bat roost features to be installed) shall be provided on site. Thereafter, the development shall be implemented in accordance with the approved details and all features provided prior to first use.
Reason: To secure biodiversity enhancements onsite, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.
No installation of external lighting shall commence until a report detailing the lighting scheme, and how this will not adversely impact upon wildlife, has been submitted to and approved in writing by the LPA. The report (if external lighting is to be installed) shall include the following figures and appendices:
- A layout plan with beam orientation
- A schedule of equipment
- Measures to avoid glare
- An isolux contour map showing light spillage to 1 lux both vertically and horizontally, areas identified as being of importance for commuting and foraging bats, locations of the existing bat roosts, and locations of bird and bat boxes/bricks/tiles.
The approved lighting plan shall thereafter be implemented as agreed.
Reason: To limit the impact of light pollution from artificial light on nature conservation and the environment in accordance with paragraph 191 of the NPPF and Policies ENV12 and ENV3 of the South Oxfordshire Local Plan 2035.
