Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the approved plans 20-05-PP-050a, 20-05-PP-051a, 20-05-PP-052a,20-05-PP-001, 20-05-PP-002a, 20-05-PP-003a, 20-05-PP-004a, 20-05-PP-005a, 20-05 -PP-006a, 20-05-PP-007a, 20-05-PP-008a, 20-05-PP-009a, 20-05-PP-010a, 20-05-PP-011a, 20-05-PP-012a, 20-05-PP-013a, 20-05-PP-014, 20-05-PP-015, 20-05-PP-100a, 20-05-PP-101c, 20-05-PP-102d, 20-05-PP-103b, 20-05-PP-104a, 20-05-PP-105c, 20-05-PP106c, 20-05-PP-107a, 20-05-PP-108, 20-05-PP-109c, 20-05-PP-110a, 20-05-PP-111a, 20-05-PP-112d, 20-05-PP-115, 20-05-PP-116a, 20-05-PP-201, 20-05-PP-202, 20-05-PP-203, 20-05-PP-204, 20-05-PP-205, 20-05-PP-206, 20-55-PP-207, 20-05-PP-208, 20-55-PP-209, 20-55-PP-400, 20-55-PP-401a, 20-55-402a, 20-55-PP-403a, 20-55-PP-404a, 20-05-PP-405a, 20-05-PP-406a, 20-55-PP-500, 20-05-PP-501, 20-55-PP-502 and accompanying supporting information except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection details as shown on the approved Arboricultural Impact Assessment report (ref: 804462-502-RPT-AIA) and Tree Protection Plan (ref: 804462-502-DRW-TPP) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The development is to be carried out in accordance with the bat mitigation and compensation plan details given in section 4 of the Ecological Assessment report (Ecology Solutions, October 2024, ref: 9182M. vf2) unless otherwise agreed in writing by the council. If/where this mitigation strategy conflicts with any European Protected Species Licence agreement, the provisions of the latter shall take precedence. A closing-out report including details of the methods used, and any bats or signs of bats found, is to be issued to the council within 6 months of completion of works.
Reason: To protect roosting bats and prevent a biodiversity net loss in accordance with national wildlife legislation, the NPPF, and Policy ENV2 of the South Oxfordshire Local Plan 2035.
No installation of external lighting shall commence until a report detailing the lighting scheme, and how this will not adversely impact upon wildlife, has been submitted to and approved in writing by the LPA. The report (if external lighting is to be installed) shall include the following figures and appendices:
- A layout plan with beam orientation
- A schedule of equipment
- Measures to avoid glare
- An isolux contour map showing light spillage to 1 lux both vertically and horizontally, areas identified as being of importance for commuting and foraging bats, locations of the existing bat roosts, and locations of bird and bat boxes/bricks/tiles.
The approved lighting plan shall thereafter be implemented as agreed.
Reason: To limit the impact of light pollution from artificial light on nature conservation in accordance with paragraph 191 of the NPPF and local policy and Policies ENV1, ENV2, ENV3 and ENV12 of the South Oxfordshire Local Plan 2035.
