Section 73a application for variation of condition 2 (Approved Plans) on P22/S3717/S73 (Variation of condition 2 (Approved plans) on application P21/S4379/FUL (Demolition of existing dwelling and construction of replacement dwelling, garage and all associated works) - enlargement of the ground and first floor areas, some minor internal changes and the addition of a new chimney position to the north elevation) - to make an amendment to the position of the proposed dwelling and garage (retrospective).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 19-191-03 and 19-191-02 Rev R, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans and supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The mixed species hedge as shown on the approved plan 19.191.02 R shall be planted prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new shrub or equivalent number of shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The proposed rooflight on the first floor of the south elevation of the development hereby permitted shall either be obscure glazed and fixed shut non-opening window or positioned so that the cill level is more than 1.7 metres above the floor level of the room in which it is to be inserted.
Reason: To safeguard the amenities of the occupiers of adjoining properties in accordance with policy DES6 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) no window(s), door(s) or other openings shall be inserted at any time in the first floor south or western elevations of the dwelling hereby approved.
Reason: To safeguard the amenities of the occupiers of adjoining properties in accordance with policy DES6 of the South Oxfordshire Local Plan 2035.
Prior to first occupation of the development hereby approved, the existing means of access onto Chalkhouse Green Lane shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report.
Reason: To ensure high standards of sustainable design and construction in accordance with policies STRAT1, DES8 and DES10 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the dwelling hereby approved, an Electric Vehicle Charging Point shall be installed and thereafter retained as such.
Reason: To ensure sustainable forms of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Any new area of hardstanding exceeding five square metres shall be constructed of permeable or porous material (e.g. gravelled surface); otherwise provision should be made available for direct run-off water, from the hard surface onto a permeable or porous area, within the curtilage of the property.
Reason: To ensure proper provision is made for the surface water drainage of the site in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
