On the balance of probability, the two north facing ground floor windows serving the annex have been in situ in the location as shown on drawing numbers 240613-03 (scale 1:50) and 240613-01 (scale 1:100), continuously for in excess of 10 years and remain in situ at the time of the application and are therefore lawful.
On the balance of probability, the use of the annex building edged in red on drawings numbers 240613-01 and 240613-02 (scale 1:50) as a separate self-contained and single dwelling house (use class C3) is lawful, having been in use as such for a continuous period of 4 years, and that use has not since been lost. It is noted that the use was continuing at the time of the application.
