Description
Reconnect a significant length of the River Thame to the Thames, comprising the following:
i. Installation of a fish pass with a rock ramp design, approximately 30m in length, downstream of the Bucks Pool.
ii. Grading and infilling of the Bucks Pool bank, and banks where the fish pass will be installed; and
iii. Removal of the existing weir, and associated bank re-profiling.
(Amended ecological, flood risk, archaeological and red line site area plans and information received 30 January 2025 and 6 March 2025. The site area is now reduced from 1.2 hectares to 0.62 hectares and additional infomration received 16 April 2025).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, LOC-002, OP1-002, AM-DoT-2023-004 05, 1070077678-01, 1070077678-02, 1070077678-04, 1070077678-07, 1070077678-09, 23RTCT11958-01, 23RTCT11958-02, AM-DoT-2023-010 04, 23RTCT11958-03, 1070077678-03, 1070077678-06, 1070077678-08, 1070077678-10, AM-DoT-2023-003 05, AM-DoT-2023-005 04, AM-DoT-2023-006 04, AM-DoT-2023-006-2 04, AM-DoT-2023-002 05, TG-21-1234-01-A and TG-21-1234-01-A-2, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall commence until a Habitat Management and Monitoring Plan (HMMP) has been submitted to, and approved in writing by, the Local Planning Authority. The HMMP shall be consistent with, and submitted alongside, the associated Biodiversity Gain Plan and include:
1) a non-technical summary;
2) the roles and responsibilities of the people or organisation(s) delivering the HMMP;
3) the planned habitat creation and enhancement works to create or improve habitat to achieve the Biodiversity Net Gain in accordance with the associated Biodiversity Gain Plan;
4) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion* of development; and
5) the monitoring methodology (including the specification of subsequent required monitoring reports) to be provided to the Local Planning Authority at monitoring intervals. The monitoring intervals shall be at years 1, 2, 5, 10, 15,
20, 25 and 30, after the completion* of development.
Thereafter, the created and/or enhanced habitat approved by the associated Biodiversity Gain Plan shall be implemented in accordance with the approved HMMP. All subsequent monitoring reports shall be submitted to, and approved in writing by, the Local Planning Authority, in accordance with the methodology and frequency specified in the approved HMMP.
(*completion is taken to be when a Building Control Completion Certificate has been obtained for the development AND all establishing habitat creation and enhancement works, as set out in the approved HMMP, have been implemented successfully).
REASON: To ensure the development delivers a Biodiversity Net Gain onsite in accordance with policy ENV3 of the South Oxfordshire Local Plan 2035, and in accordance with Schedule 7A of the Town and Country Planning Act 1990.
Prior to the commencement of the development, details (including specification/design, position, height, orientation) of a scheme of features to be provided for protected and priority species, shall be submitted to and approved in writing by the local planning authority. The scheme shall be designed in conjunction with a suitably qualified ecologist. A minimum number of biodiversity enhancement features shall be provided onsite as follows: three bird nest boxes, three bat boxes, and two artificial holts for otter. Thereafter, the development shall be implemented in accordance with the approved details. All features shall be provided prior to first use and shall be retained and maintained thereafter.
REASON: To secure biodiversity enhancements onsite, in accordance with policy ENV2 of the South Oxfordshire Local Plan 2035, the South and Vale Joint Design Guide and paragraphs 187d and 193d of the NPPF.
No development shall commence until a Written Scheme of Investigation has been submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall be carried out by a professional archaeological organisation in accordance with the approved Written Scheme of Investigation.
Reason - To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with policy ENV6 of the South Oxfordshire Local Plan 2035 and the NPPF.
No development shall commence on site without the appointed archaeologist being present. Once the archaeological monitoring and recording action has been completed its findings shall be submitted to and agreed in writing by the Local Planning Authority, as agreed in the Written Scheme of Investigation and must include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to and agreed in writing by the Local Planning Authority within two years of the completion of the archaeological fieldwork.
Reason To safeguard the identification, recording, analysis and archiving of heritage assets before they are lost and to advance understanding of the heritage assets in their wider context through publication and dissemination of the evidence in accordance with policy ENV6 of the South Oxfordshire Local Plan 2035 and the NPPF.
Following the approval of the Habitat Management and Monitoring Plan (HMMP) referred to in condition 3, no use of the development shall take place until evidence confirming that the development is complete* has been submitted to, and approved in writing by, the Local Planning Authority. The date of completion shall be confirmed in that evidence. (*completion is taken to be when a Building Control Completion Certificate has been obtained for the development AND all establishing habitat creation and enhancement works, as set out in the approved HMMP, have been implemented successfully).
REASON: To ensure the development delivers a Biodiversity Net Gain on site in accordance with policy ENV3 of the South Oxfordshire Local Plan 2035, and in accordance with Schedule 7A of the Town and Country Planning Act 1990.
The development shall be carried out in accordance with the submitted flood risk assessment (ref Dorchester Fish Pass and Weir Removal Flood Risk Assessment). There shall be no raising of existing ground levels on the site, in accordance with document 'Consultation Comments and Responses' (30/01/2025) rows 3 to 5. The flood mitigation measures shall thereafter be retained and maintained throughout the lifetime of the development.
Reason: To prevent obstruction to the flow and storage of flood water, which would lead to an increase in flood risk elsewhere in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
