Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 4357-4 D, 4357-3 D, 4357-1 D, LOC-001 and 4357-2 D, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.
The tree protection details as shown on the approved " Full Arboricultural Method Statement - V1" document reference PP-13163118 August 2024 and Tree Protection Plan reference HTS-TPP-01A shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
No development hereby permitted shall take place except in accordance with the terms and conditions of the Council's Organisational Licence (WML-OR150, or a 'Further Licence') and with the proposals detailed on plan "Whitchurch Primary School: Impact plan for great crested newt District Licensing (Version 1)" dated 17th October 2024.
Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence (WML-OR150, or a 'Further Licence'), section 15 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006.
Prior to the occupation of the development, biodiversity enhancements designed in conjunction with a suitably qualified ecologist, to include two bird and / or bat boxes provided on site, shall be installed under the supervision of a suitably qualified ecologist. Thereafter, the development shall be implemented in accordance with the approved details and all ecological features shall be provided on site prior to first use of the development hereby permitted.
Reason: To secure biodiversity enhancements onsite, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.
Any external lighting will only be permitted in accordance with a lighting scheme to be submitted to and approved in writing by the Local Planning Authority prior to its installation. If external lighting is to be installed, the scheme shall be designed to following guidance in the Institute of Lighting Professional Guidance for the reduction of obtrusive light and details shall include:
- A layout plan with beam orientation
- A schedule of equipment
- Measures to avoid glare
- An isolux contour map showing light spillage to 1 lux both vertically and horizontally, areas identified as being of importance for commuting and foraging bats, and locations of bird and bat boxes
- Details of all the equipment uses, specific lamps, luminaries and columns with images.
- For each luminaire a full technical specification (e.g. wattage, colour rating)
- Details of lighting operation hours
Any such lighting shall be implemented in accordance with the approved details.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies ENV1, ENV2, ENV3 and ENV12 of the South Oxfordshire Local Plan 2035 and paragraph 191 of the National Planning Policy Framework.
