Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 9 June 2026 . Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans; Location plan - drawing no. 19130- LOO1 Proposed site plan- drawing no. 19130- PP011- A Plot 1, proposed drawing no. 19130- PP1103- M Proposed garages to Plot 1 - drawing no. 19130- PP1201- E Plot 2- proposed drawing no. 19130- PP2103- I Plot 3 - proposed plans - drawing no. 19130- PP3102- H Garage plot 2&3 drawing no. 19130- PP2201- G Plot 4- proposed plans - drawing no. 19130- PP4102- J Proposed landscaping drawing no 1683 L1 rev I Proposed communal areas drawing no 1683 L2 rev E Proposed wildflower areas drawing no 1683 L3 rev B except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The development shall be undertaken in accordance with the construction traffic management plan scheme approved under P23/S2784/DIS unless otherwise agreed in writing by the Local Planning Authority Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The development shall be undertaken in accord with the Archaeological Written Scheme of Investigation scheme approved under P23/S2784/DIS unless otherwise agreed in writing by the Local Planning Authority Reason - To safeguard the recording of archaeological matters within the site in accordance with Policy ENV9 South Oxfordshire Local Plan 2035.

Following the approval of the Written Scheme of Investigation dated July 2023 by Thames Valley Archaeological Services referred to in condition 4, no development shall commence on site until the agreed staged programme of archaeological evaluation and mitigation shall be carried out by the commissioned archaeological organisation in accordance with the approved Written Scheme of Investigation. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to the Local Planning Authority within two years of the completion of the archaeological fieldwork. Reason To safeguard the identification, recording, analysis and archiving of heritage assets before they are lost and to advance understanding of the heritage assets in their wider context through publication and dissemination of the evidence in accordance with Policy ENV9 of the of the South Oxfordshire Local Plan 2035.

The development shall be undertaken in accordance with the approved Arboricultural Method Statement and Tree Protection Plan, approved under P23/S3321/DIS unless otherwise agreed in writing by the Local Planning Authority Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of any development above ground, with the exception of any demolition, a full surface water drainage scheme in accordance with the surface water drainage hierarchy as set out in Part H of the Building Regulations, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policies ENV12 and EP4 of the South Oxfordshire Local Plan 2035. The development shall be undertaken in accordance with the approved great crested newt compensation scheme, approved under P23/S2784/DIS unless otherwise agreed in writing by the Local Planning Authority Reason: In order to adequately compensate for negative impacts to great crested newts, and in line with paragraphs 179 and 185 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006.

Prior to development taking place above slab level, a photographic schedule of all external materials shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the works shall be carried out in accordance with the approved details. Reason: To safeguard the special character and appearance of the Little Milton Conservation Area in accordance with Policy ENV6 and ENV8 of the South Oxfordshire Local Plan 2035 and Policy LM4 of the Little Milton Neighbourhood Plan. The landscaping scheme as shown on the approved plan Replacement Dwellings, New Tree Planting Plan Rev1 shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the soft landscaping so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, replacement planting, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development, the existing means of access onto Gold Street shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The vision splays shown on the approved plan 19130-PP0011-A shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan plan 19130-PP0011-A and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with approved drawing Community Managed Areas Plan Rev E and the proposed bench provided prior to the occupation of the development and thereafter retained and maintained as per the plan. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report. Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of any dwelling hereby approved, an Electric Vehicle Charging Point shall be installed for each dwelling and thereafter retained as such. Reason: To ensure sustainable forms of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

No development hereby permitted shall take place except in accordance with the terms and conditions of the Council's Organisational Licence (WML-OR112, or a 'Further Licence') and with the proposals detailed on plan "The Site Of Milton House: Impact Plan for great crested newt District Licensing (Version 1)", dated 6th March 2023. Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the Organisational Licence (WML-OR112, or a 'Further Licence'), paragraphs 179 and 185 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006.

The development hereby permitted shall be implemented in accordance with the recommendations of Construction Environment Management Plan for Biodiversity dated January 2023 and Biodiversity Net Gain Plan dated 19/01/23 submitted with the application in all respects. All ecological mitigation and enhancement features shall be delivered on site prior to first use and retained as such thereafter. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. Reason: To protect the important species on the site, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the character and appearance of the conservation area in accordance with Policies ENV6 and ENV8 of the South Oxfordshire Local Plan 2035 and Policy LM4 of the Little Milton Neighbourhood Plan.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the character and appearance of the conservation area in accordance with Policies ENV6 and ENV8 of the South Oxfordshire Local Plan 2035 and Policy LM4 of the Little Milton Neighbourhood Plan.
