Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, P04.C, P01.B, EX04, EX03, P03.B, EX02, P02.B, EX01.A, P05.B, EX05, EX06.B and P06.B, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development above slab level hereby permitted. These details shall include schedules of new trees and shrubs to be planted (noting species, plant sizes and numbers/densities), the identification of the existing trees and shrubs on the site to be retained (noting species, location and spread), any earth moving operations and finished levels/contours, and an implementation programme. The scheme shall be implemented prior to the first occupation or use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. At this site, replacement tree species will need to be climate resilient and comply to the principles of right tree, right place. Where possible, species selection should opt for large-canopied trees which provide greater eco-system services.
Reason: To safeguard the historic character of the area and setting of the listed building help to assimilate the development into its surroundings and to provide biodiversity net gain at the site in accordance with Policies STRAT1, ENV1, ENV2, ENV3, ENV6, ENV7, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development. At this site an arboricultural assessment as to the development impacts on tree T2 (Hazel) will be required, if retained it will need to be protected and possibly pruned. A detailed tree work specification will be required and included within the Tree Protection Plan (TPP).
Reason: To safeguard trees which are visually important and make a contribution to the character of the historic environment and provide opportunities for nesting birds in accordance with Policies STRAT1, ENV1, ENV2, ENV3, ENV6, ENV7, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development hereby approved (including any works of demolition, a method statement for roof works to the retained portion of the main house shall be submitted to and approved in writing by the Local Planning Authority. This shall include:
1. The details of a toolbox talk to be given to all roofing contractors working on the project by a suitably qualified ecologist, before works commence.
2. The procedure for soft stripping of the area to be subject to repairs, using hand tools only.
3. The procedure to be followed in the unlikely event that a bat is discovered during the works.
REASON: To avoid impacts on bats in line with Policy ENV2 of the South Oxfordshire Local Plan 2035.
Notwithstanding that shown on the approved plans, details, including photographic samples of materials and drawings as necessary, in respect of the following, shall be submitted to and approved in writing by the Local Planning Authority before the relevant part of the work has begun:
a. photographic samples all all proposed materials to be use in the construction of the extensions hereby approved
b. any extensive repairs to the existing joinery
c. type and colour of paint finish proposed across the existing timber windows and doors
Thereafter the works shall be carried out in accordance with the approved details.
Reason: To safeguard the special architectural or historic interest of the listed building in accordance with Policy ENV7 of the South Oxfordshire Local Plan 2035.
Prior to any works starting on site, a sensitive lighting strategy for bats shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall: a) identify those areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites or resting places or along important routes used to access key areas of their territory, for example for foraging; and b) show how and where external lighting will be installed (through provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their breeding sites or resting places.
All external lighting shall be installed in accordance with the specifications and locations set out in the strategy. Under no circumstances should any other external lighting be installed without the prior consent from the local planning authority. If no external lighting is proposed, this should be confirmed in writing to the Local Planning Authority before any works start on site.
REASON: To avoid impacts on bats from insensitive external lighting in line with Policy ENV2 of the South Oxfordshire Local Plan 2035.
