Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 22 December 2026. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 20034-SBR-SW-ZZ-DR-A-84900-HV Rev 1, 20034-SBR-SW-ZZ-DR-A-83900 Rev 3, 20034-SBR-SW-ZZ-DR-A-80903 Rev 1, 20034-SBR-SW-ZZ-DR-A-83901 Rev 3, 20034-SBR-SWZZ-DR-A-84901 Rev 3, 20034-SBR-SW-ZZ-DR-A-81900 Rev 3, 20034-SBRSW-ZZ-DR-A-81901 Rev 3, 20034-SBR-SW-ZZ-DR-A-80901 Rev 2, 20034-SBR-SW-ZZ-DR-A-80902 Rev 3, 20034-SBR-SW-ZZ-DR-A-81902 Rev 3 and 332110886/5501/PL001 REV2, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

No development above slab level or alteration to the highway shall commence until a revised detailed plan of the vehicular access has been submitted to and approved by the Local Planning Authority. A revised plan shall include but not be limited to details of the following: · Road Safety Audit stage 1 in accordance with GG119 · visibility splays; · signing; · double yellow lines and centre-line markings; · demarcation of hardstanding; · proximity to the roundabout including any kerb realignment · streetlighting assessment and column(s) relocation; · cross-sections · drainage. Prior to the operational use of the site, the approved access arrangements, including visibility splays and all associated highway works, shall be provided and thereafter retained Reason: In the interests of highway safety and accordance with policy TRANS 5 of the South Oxfordshire Local Plan 2035. The development shall be implemented in accordance with the approved Biodiversity Offsetting certificate submitted by TOE and dated 5 February 2024, and the Biodiversity Net Gain Plan prepared by MKA Ecology. Reason: To compensate and mitigate for the net loss of biodiversity resulting from the development by providing biodiversity enhancements off site in accordance with policy ENV3 and ENV5 of the South Oxfordshire Local Plan 2035 and paragraphs 180 and 186 of the National Planning Policy Framework.

The development shall accord with the Construction Environmental Management Plan (CEMP) approved via condition discharge application P24/S0051/DIS. Reason: This condition is necessary to ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in line with national planning policy. This approach is supported by policy ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 180 and 186 of the National Planning Policy Framework which recognise that the planning system should conserve and enhance the environment by minimising impacts on and providing net gains for biodiversity.

The development shall be implemented in accordance with the Biodiversity Enhancement Plan (BEP) submitted by MKA Ecology and dated 12th January 2024. The development shall also accord with all of the biodiversity enhancements described in section 5 of the supporting Preliminary Ecological Appraisal submitted by MKA Ecology, Ref: 138723. Reason: To secure biodiversity enhancements on site, in accordance with policy ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 180 and 186 of the NPPF.

The development shall accord with the landscaping scheme approved via condition discharge application P24/S0164/DIS and shall be implemented prior to the first occupation or use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the local planning authority, shall be planted and properly maintained in a position or positions first approved in writing by the local planning authority. Reason: To help to assimilate the development into its surroundings in accordance with policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The trees shall be protected in accordance with the approved tree protection scheme (P2863-TPS01 V3) and tree protection plan (drawing no. P2863-TPP01 REV V3) submitted by Ligna Consultancy. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The developer shall confirm in writing to the local planning authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken. Where land contamination investigation/remedial works are required this must be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 Investigation of potentially contaminated sites and submitted to and approved in writing by the local planning authority. Reason - To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use. The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority. Reason: To protect the occupants of nearby residential properties from noise and dust disturbance in accordance with policy ENV12 and DES6 of the South Oxfordshire Local Plan 2035.

The developer shall ensure that appropriate provision is made for the control of noise and dust emanating from the site, so as not to cause undue disturbance to the occupants of nearby residential properties. Reason: To protect the occupants of nearby residential properties from noise and dust disturbance in accordance with policy ENV12 and DES6 of the South Oxfordshire Local Plan 2035.
