Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, GP-TCP-01B, GP-TPP-01B, DN1007-621, DN1007-603, DN1007-625, DN1007-626, DN1007-627, DN1007-622, DN1007-602, DN1007-624, DN1007-601, DN1007-623, DN1007-620 and DN1007-628, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of any site works or operations, including demolition and site clearance relating to the development hereby permitted, an Arboricultural Method Statement (AMS) and accompanying Tree Protection Plan (TPP) shall be submitted to and approved in writing by the Local Planning Authority.
Although an AMS was provided at the planning stage (ref: Ashley Tree Surveys AMS - December 2024 Revision), this was not acceptable to acceptably demonstrate that protected and retained trees would be adequately protected. The following additional details are required within the AMS and TPP:
1. Show recommended construction route on the Tree Protection Plan;
2. Protective fencing / ground protection for TPO sycamore tree (shown as T9 on tree plan). If not required, please highlight on plan that this is Construction Exclusion Zone;
3. Is access facilitation pruning required to T9?;
4. At the rear of the property, does the position of the protective fencing realistically reflect the extent of working space required for the construction of the retaining wall (for the basement). If necessary, this needs to be pulled back and partly replaced by appropriate ground protection;
5. The AMS states at section 7.5 "of construction activities within the trees RPA," can these please be specified.
6. The AMS report states that ground protection will be used to ensure there is no damage to the off-site ash tree (G7) however none has been shown on the TPP, this needs to be shown and examples of appropriate ground protection provided;
7. To ensure best practice and provide adequate tree protection measures, the AMS report should also be expanded to include arboricultural supervision at critical stages of the development which for this site will need to include:
· Installation of tree protection measures.
· Liaison with groundwork contractor prior to the commencement of proposed excavation works to ensure that tree protection measures are adequate and robust.
· Liaison with sheet piling contractor prior to works commencing and review of tree protection measures.
· Liaison, as and when required, with contractors throughout the duration of development works.
Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
