The applicant has failed to provide sufficiently precise and unambiguous evidence, and the Local Planning Authority is not satisfied that the planning permission granted under application P13/S3435/HH has been implemented. Planning permission under application P13/S3435/HH was granted for the "Demolition of existing single storey extension. Erection of a two/single storey side extension and two storey rear extension". None of the elements listed in the description have commenced.
The works cited by the applicant to constitute the implementation of the planning permission are not relevant to permission P13/S3435/HH, and could not have been dealt with under a householder application. The works that have been carried out would have required full planning permission to include a change of use of land and variation/removal of a previous condition on an application to create the access to the property.
The construction of the access to Hatchery Cottage was the subject of a separate planning application (P04/W1252) which showed a smaller red edged site area than the current site area and required the erection of the fencing to mark a boundary under condition 3 which required the fencing to be provided and retained. A change to land ownership appears to have occurred increasing the residential curtilage and the P04/W1252 condition 3 fence has been removed and the parking area has been re-arranged. It remains open to the Council to enforce against the breach of condition until December 2026.
The P13/S3435/HH planning permission does not include the variation of condition 3 from P04/W1252 or the increase in the size of the curtilage, it only includes the demolition of a single storey extension, and further extensions to the dwelling. As such, the P13/S3435/HH planning permission has not commenced and the permission has expired.
