An assessment of the available evidence, on the balance of probability, supports the conclusion that the engineering operations raising the ground levels to the levels shown on the Topographical survey drwgno FESD-217139-003 Rev C extracted from Flood Risk Assessment (FRA) prepared by Forge Engineering Design Solutions Ltd (ref FEDS-217139, dated February 2019) were substantially completed a period exceeding 4-years prior to the application date. The development is therefore immune from enforcement action under section 171B(1) (as it existed on 24 April 2024) of the Town and Country Planning Act 1990 ('the Act') and Part 3 of The Planning Act 2008 (Commencement No. 8) and Levelling-up and Regeneration Act 2023 (Commencement No. 4 and Transitional Provisions) Regulations 2024, and must be regarded as lawful within the meaning of section 191 of the Act.
