Variation of conditions 2 (approved drawings) and 10 (Energy Statement) on application P21/S3827/FUL (Proposed demolition of existing dwelling and erection of 2 detached dwellings and the creation of new vehicular accesses) - for timber boarding to be removed and replaced with matching brickwork and photovoltaic panels added to the roof.
Conditions / Refusal Reasons
The development shall be carried out in accordance with the approved phasing contained within the phasing plan reference 20076-C01 unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure a comprehensive and viable development in accordance with Policies STRAT1 and INF1 of the adopted South Oxfordshire Local Plan 2035
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 2076-P101A, 2076-P201C and 2076-P001-BN,
and the following plans approved under application reference P21/S3827/FUL;
20076 P100, 20076 L001, 20076 SU01, 20076-P200-B and 20076-PV001-B,
and the following plan approved under application reference P22/S1348/NM;
20076-C01
except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That, unless otherwise agreed in writing the development shall be carried out in accordance with the surface water and foul water details approved under application reference P22/S3095/DIS in letter darted 3 January 2023.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
That, unless otherwise agreed in writing by the local planning authority the Gas protective measures shall be incorporated into the design of the building and in accordance with the details approved under application reference P22/3095/DIS in letter dated 3 January 2023
The gas protective measures shall be fully implemented and a report submitted to and approved in writing by the LPA before occupation of the dwellings.
Reason: To ensure that any landfill gas contamination is identified and all necessary remediation works are carried out in the interest of the safety of the development and the environment, and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
Prior to occupation of the dwellings hereby permitted the proposed means of access onto Bungalow Close is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Before the proposed access is first used, the existing access onto Bungalow Close shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the dwellings hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 20076-P001-B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of any dwelling hereby approved, a scheme to provide the dwelling with Electric Vehicle Charging Points shall be submitted to and approved in writing by the Local Planning Authority. Thereafter each Electric Vehicle Charging Point shall be implemented prior to the occupation of the dwelling.
Reason: To ensure sustainable forms of transport are provided in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement dated 16/10/2023 hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the material schedule accompanying the application hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with all of the recommendations made in section 5.2 of the supporting Bat Survey Report (Windrush Ecology Ltd, August 2021).
Reason: To minimise the impacts of development on biodiversity, in accordance with Policy ENV2 of the SOLP and paragraphs 174 and 180 of the NPPF.
The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken. Where land contamination investigation/remedial works are required this must be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 'Investigation of potentially contaminated sites' and submitted to and approved in writing by the local planning authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement of the dwelling shown as Unit 2 on drawing 20076-P001-B or addition of buildings incidental to the dwellinghouse as described in Schedule 2, Part 1, Classes A and E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
The cill level of the roof light serving the en-suite bathroom of bedroom 3 of Unit 1 in the southern elevation shall be at least 1.7 metres above the floor level of the associated rooms and shall be retained as such. No additional rooflights shall be inserted into the southern elevation of the dwelling shown as Unit 1 hereby approved without planning permission from the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
