The proposed garden room is situated in an area of outstanding natural beauty (AONB) and would be situated more than 20 metres from the nearest wall of the dwelling. Buildings or enclosures are only permitted in the AONB if they are 10 square metres or less in floor area. The proposed garden room has a floor area of 37.2 square metres which would not be authorised under Schedule 2, Part 1 Class E of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The proposal is not lawful and therefore the certificate of lawful development is refused. An application for planning permission is required.
