Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 16/12/2025.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 23010-D-100C, LED-CONS-SITE 0830-200 Rev B, LED-CONS-SUB_0820-100 Rev C, PL-EX-PRO-OS-1000, LED-CONS-SUB_0820-100 Rev E, 23010-D-100E, LED-CONS-SITE 0830-200 Rev D, PL_PRO_SITE_1050, PL_PRO_ELEV_1030_ REV A, PL_PRO_SITE_1016_REV A and PL_PRO_SITE_1017_REV A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Any changes in levels shall only be carried out in accordance with details agreed under application P23/S1428/DIS.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
All materials to be used in the external construction and finishes of the development hereby permitted shall only be carried out in accordance with details agreed under application P23/S1428/DIS.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The first floor en-suite window in the west-facing elevation and any glazing on the west-facing and east-facing sides of the first floor balcony of the dwelling hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight (or other means of opening to be first agreed in writing by the Local Planning Authority) prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
The timber louvres on the south-facing first floor balcony shall be implemented as approved prior to first occupation of the development hereby approved and shall thereafter be retained in situ.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035
With the exception of the approved first floor balcony, notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) no other parts of the roof of the development hereby approved shall be used as a balcony or terrace nor shall any access be formed thereto.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions, Class D - Porch, Class E - Outbuildings, Class F - Hardsurfacing shall be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition to safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.
Any external heating or energy generation system to be used in the development hereby permitted shall only be carried out in accordance with details agreed under application P23/S1428/DIS.
Reason: To ensure high standards of sustainable design and construction and an acceptable visual and amenity impact in accordance with Policies DES1, DES2, DES6, DES16, ENV1 and ENV12 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of development, the vegetation on each side of the access for the carport shall be reduced to a height not exceeding 0.9 for a distance of at least 2.0m in each direction from the said access and thereafter retained as such.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan PL/PRO/SITE/1015, Rev AH and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The garage/carport accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The landscaping scheme as agreed under application P23/S1428/DIS shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the soft landscaping so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, replacement planting, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The tree protection details as agreed under application P23/S1428/DIS shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with all of the ecological avoidance and mitigation measures stated in section 4.2 of the supporting Preliminary Ecological Appraisal (United Environmental Services Ltd, 04/05/2022, UES03614/04).
Reason: To minimise the ecological impacts of development, in accordance with Policy ENV2 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.
The development hereby approved shall be implemented in accordance with the approved biodiversity enhancements agreed under application P23/S1428/DIS and all biodiversity enhancements shall be delivered prior to first occupation.
Reason: To secure the delivery of onsite biodiversity enhancements, in accordance with Policy ENV2 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.
No external lighting shall be installed on the site other than in accordance with details agreed under application P23/S1428/DIS.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies ENV1, ENV2, ENV3 and ENV12 of the South Oxfordshire Local Plan 2035.
The surface water drainage scheme shall be implemented in accordance with the details agreed under application P23/S1428/DIS prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, an Electric Vehicle Charging Point shall be installed for the approved dwelling and thereafter retained as such.
Reason: To ensure sustainable forms of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
