Conditions / Refusal Reasons
That the development must be completed within a period of three years starting with the prior approval date. Reason: To comply with the requirements of Class MA.2 (5) of The Town and Country Planning (General Permitted Development) Order 2015 (as amended)

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans and as outlined within the application documents, except as controlled or modified by conditions of this permission: 23/088 - 03 23/088 - 04 23/088 - 05 Reason: To secure the proper planning of the area in accordance with The Town and Country Planning (General Permitted Development) Order 2015 (as amended)

Prior to the commencement of development a full scheme of an insulation package which prevents noise transmission from the ground floor commercial element, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall assume the breadth of the uses permissible and possible by the Class E use across the ground floor of the building and shall be designed, specified and constructed so that the sound insulation performance of the structure and the layout of the dwellings is such that the indoor ambient noise levels of the residential properties do not exceed the values detailed in Table 4 of BS 8233:2014 "Indoor ambient noise levels for dwellings". The approved scheme and any mitigation shall be implemented prior to the first use or occupation of the development and retained as such thereafter. For waste collections the flats will be on our sack service to be stored within each property between collections. Provision for the storage of wheelie bins within the property's boundary should be made if the residential units want to be on this service. Reason: To allow future occupants to access existing waste services in the area and protect the amenity of future occupants of the development from noise and nuisance from the ground floor commercial premises in accordance with condition of 2(d) of Schedule 2, Part 3, Class MA of The Town and Country Planning (General Permitted Development) Order 2015 (as amended). Any building permitted to be used as a dwellinghouse by virtue of Class MA is to remain in use as a dwellinghouse within the meaning of Class C3 of Schedule 1 to the Use Classes Order and for no other purpose, except to the extent that the other purpose is ancillary to the use as a dwellinghouse. Reason: To comply with the requirements of Class MA.2 (6) of The Town and Country Planning (General Permitted Development) Order 2015 (as amended)
