Applying the judgement of Sullivan. J in R. Hall Hunter v First Secretary of State [2007] 2 P. & C.R. 5 polytunnels are operational 'development' within the meaning of section 55(1) of the TCPA 1990. Part 6 (Agricultural and forestry) of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) ("the Order") has no remit for operational development on agricultural units measuring less than 0.4 hectares. The proposed construction of a polytunnel on the small parcel of agricultural land measuring no more than 0.31 hectares is not permitted by Part 6 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) ("the Order"), or any other Part of the Order, and would be unlawful development by reference to Section 58 of the Town and Country Planning Act 1990 and Article 3 of the Order.
