Variation of condition 2 (parking & manoeuvring areas retained) on planning application P20/S3618/N5B - modification to approved parking layout
(Change of use of ground floor shop (currently occupied by Wheelers Electrical) to ground floor apartment. The existing premises has adequate window provision subject to replacement).
Conditions / Refusal Reasons
The development must be completed within a period of 3 years starting with the prior approval date of 18 November 2023.
Reason: To comply with paragraph M.2- (3) (a) of Class M of Schedule 2 of Part 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (As amended)
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1181.G.1, 1181.G.2, 1181.G.5, 1181.G.3 and 1181.G.4, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 1181.G.4 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: To comply with paragraph M.2- (1) (a) of Class M of Schedule 2 of Part 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (As amended) and to ensure that sufficient parking provision is provided in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035 and Policy CNP H6 of the Cholsey Neighbourhood Plan.
The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken has been submitted to and approved in writing by the local planning authority.
Reason: Reason: To comply with paragraph M.2- (1) (b) of Class M of Schedule 2 of Part 2 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (As amended) and to ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
