Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, KSA.1196.PL.03, KSA.1196.PL.02, KSA.1196.PL.01 REV A and KSA.1196.PL.04, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans and supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies STRAT1, ENV1, ENV6, ENV7, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken on the residential land hereby approved and marked in yellow on approved plan KSA.1196.PL.04 without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the character of the area at the very edge of the settlement and landscape setting of the Chilterns AONB, in accordance with Policies STRAT1, ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the erection, extension or alteration of an industrial building or a warehouse as described in Schedule 2, Part 7, Class H of the Order shall not be undertaken on the B8 Storage and Distribution land hereby approved and marked in blue and purple on approved plan KSA.1196.PL.04 without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the character of the area, the amenity of neighbouring residents and the openness of the countryside in accordance with policies STRAT1, ENV1, ENV6, ENV7, DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

No goods, materials, plant or machinery shall be stored, repaired, operated or displayed in the open without the prior permission of the Local Planning Authority. Reason: To safeguard the character of the area, the amenity of neighbouring residents and the openness of the countryside in accordance with policies STRAT1, ENV1, ENV6, ENV7, DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

No additional external lighting shall be installed on the land, marked in purple and blue on approved plan KSA.1196.PL.04 other than in accordance with details, which have first been submitted to and approved in writing by the Local Planning Authority. Details shall include location of the external lights and product specification. Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies STRAT1, ENV1, ENV6, ENV7 and ENV12 of the South Oxfordshire Local Plan 2035.

The hours of operation for the B8 storage units and land, marked in purple and blue on approved plan KSA.1196.PL.04 shall be restricted to 08:00 - 18:00 Monday to Friday and 08:00-13:00 on a Saturday. No operations shall take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
