Conditions / Refusal Reasons
The site lies adjacent to St Mary's Church which is a grade 1 listed building. The elevation plans and supporting information provide insufficient information in relation to design details and materials to satisfactorily assess the impact of the proposal on the setting of the listed building. As such it is contrary to policies ENV6 and ENV7 of the South Oxfordshire Local Plan, the Joint South and Vale Design Guide, advice within the National Planning Policy Framework and policy C2 and Appendix 1 Supporting Statement Heritage Assets of the Chalgrove Neighbourhood Plan made December 2018.
The site is bordered by fluvial flood zone 3. Safe access onto Church Lane is also prevented because of fluvial flood zone 3.
The applicant has not submitted a Flood Risk Assessment or Product 4 flood level data, Emergency Evacuation Plan and Sequential/Exception Tests have also not been submitted. Furthermore a feasible surface water drainage proposal incorporating SuDS has also not been submitted. As such, the proposal is contrary to policy EP4 of the South Oxfordshire Local Plan 2035, advice within the National Planning Policy Framework and Appendix 1 Supporting Statement Flooding of the Chalgroe Neighbourhood Plan made December 2018.
Insufficient information has been provided to determine the full impact of the proposed development in relation to trees. No arboricultural information has been included with this application. It is clear trees growing within and adjacent to this site could be affected by the proposed development impacting on the character of the area. As such the proposal is contrary to policies ENV1, DES1,and DES2 of the South Oxfordshire Local Plan 2035, advice within the Joint South and Vale Design Guide and to British Standard Bs 5837 2012 Trees in relation to design, demolition and construction.
Insufficient information has been provided in relation to parking, and manoeuvrability within the site to demonstrate that vehicles can park safely off road and exit and egress the site safely. As such the proposal is contrary to policy TRANS5 of the South Oxfordshire Local Plan 2035 and to policy H4 of the Chalgrove Neighbourhood Plan made December 2018.
Policy DES10 of the SOLP requires all new dwellings to achieve at least a 9% reduction in carbon emissions compared with 2022 Building Regulations compliant base case. An energy statement is required to demonstrate compliance with this policy. No Energy Statement has been submitted with this application. As such the proposal is contrary to policy DES10 of the South Oxfordshire Local Plan 2035.
Policy ENV3 of the SOLP seeks to ensure that all development provides a net gain in biodiversity where possible. As a minimum, there should be no net loss of biodiversity. All proposals should be supported by evidence to demonstrate a biodiversity net gain. No information in relation to biodiversity has been submitted with this application. As such, it is contrary to policy ENV3 of the South Oxfordshire Local Plan 2035 and to Appendix 1 Supporting Statement Biodiversity of the Chalgrove Neighbourhood Plan made December 2018.
