Demolition of existing barn/storage shed & erection of new two storey 3-bedroom detached dwelling, detached double garage with accommodation in roof space, sewage treatment plant, landscaping works
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 7th August 2023.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1940.004 Rev 0, 1940.06 Rev 0, 1940.07 Rev A, 3069, 1940.002 Rev A, 1940.005.0, 1940.013 Rev A, 1940.003 Rev B, 1940.008 Rev B, 1940 001 A, 1940 011 A, 1940 012 A, 1940 09 A, LOC001 and 1940 010 A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Except in the case of any building work hereby permitted, no change in the levels of the land shall take place unless in accordance with a detailed scheme which shall have been submitted to and approved in writing by the Local Planning Authority before any development commences on site. The scheme shall include details of existing and proposed ground levels.
Reason: To ensure a satisfactory form of development in accordance with Policies DES1, DES2, ENV1 and H18 of the South Oxfordshire Local Plan 2035.
The bricks and tiles to be used in the external construction and finishes of the development hereby permitted shall be in accordance with those approved under applications P20/S3779/DIS and P20/S4489/DIS. Prior to the commencement of any development above foundation level, a schedule of any other materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the local planning authority.
Reason: To safeguard the character of the area in accordance with Policies DES1, DES2, ENV1 and H18 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions, Class E - Outbuildings and Class F - Hardstandings shall be undertaken without the prior written permission of the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies DES1, DES2, ENV1 and H18 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 1940 001 A and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies H18 and TRANS5 of the South Oxfordshire Local Plan 2035.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies H18 and TRANS5 of the South Oxfordshire Local Plan 2035.
The landscaping scheme as shown on the previously approved MASTERPLAN (CAT-001) dated May 2020 from planning permission P20/S1337/FUL shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies DES1, DES2, ENV1 and H18 of the South Oxfordshire Local Plan 2035.
The tree protection details as shown on the approved Arboricultural Report Ref 20 1833 Date 22/07/2020 and shown on the Tree Protection Plan (20 1826 TPP 001 Rev 4) from planning permission P20/S1337/FUL shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies DES1, DES2, ENV1 and H18 of the South Oxfordshire Local Plan 2035.
The first floor area of the approved garage hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Wychwood Barn.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies ENV1, H18 and TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, a scheme of external lighting for the site shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, external lighting shall only be provided on site in accordance with the approved details. The external lighting scheme should seek to minimise light spill and avoid illuminating the nearby tree line and hedgerows, taking account of best practice guidance.
Reason: To minimise the impacts of development on biodiversity and the rural character of the countryside, in accordance with Policies ENV1, ENV3, ENV12 and H18 of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF.
Prior to the first occupation of the development hereby approved, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority and shall be carried out in accordance with the approved details. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with permits and calculations to evidence this.
Reason: To prevent pollution in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
