The District Council considers that the existing dwelling on the site has been demolished and that that the structure for which a certificate of lawfulness is sought comprised part of the replacement dwelling which was erected without planning permission. As such, the building does not constitute Permitted Development as described under Part 1, Class A of the Town and Country Planning (General Permitted Development) Order 2015 and it is not lawful within the meaning of Section 191 of the Town and Country Planning Act 1990.
