Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 01, 02, 03, 04, 05A, 06A, 07A and 08A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the application form and on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H13, G2 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The proposed window on the first floor of the east (side) elevation of the development hereby permitted shall either be obscure glazed with a minimum of level 3 obscurity and a fixed shut non-opening window or positioned so that the cill level is more than 1.7 metres above the floor level of the en-suite.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2 and H13 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the extended garden area hereby approved of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
The living accommodation hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Woodsgift House.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy, and the site is an unsustainable location where new housing is not permitted, in accordance with Policies H13, H4 and D4 of the South Oxfordshire Local Plan 2011 and Policy CSR1 of the South Oxfordshire Core Strategy 2027.
Only one tennis court may be installed on the site. The tennis court hereby permitted is permitted, and shall only be erected, in place of the tennis court granted permission under reference P18/S4011/FUL.
Reason: To ensure that only one tennis court is constructed to prevent harm to the character of the site and surrounding area and in the interests of amenity in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
