The proposed development falls within Class A and B of Part 1 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) ("the Order") and would be lawful development by reference to Section 58 of the Town and Country Planning Act 1990 and Article 3 of the Order. This is on the basis that the the materials used in any exterior work are of a similar appearance to those used in the construction of the exterior of the existing dwellinghouse, and that the upper-floor window located in the side elevation is obscure-glazed, and non-opening, unless the parts of the window which can be opened are more than 1.7 metres above the floor of the room in which the window is installed.
