Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 0200 P02, 0201 P02, 2018034-A-P-00-201 A, 0787.1.1 B, 0787.1.2 B, 2018034-A-P-00-002 Rev G, 0712 Rev P01, 2018034-A-P-00-101 Rev A, 2018034-A-P-00-102 Rev B, 2018034-A-P-00-103, 2018034-A-P-00-001, 0700 Rev P03, 0710 Rev P03, 0711 Rev P03 and 2018034-A-P-00-104 Rev A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall commence unless and until a certificate confirming the agreement of an Offsetting Provider to deliver a Biodiversity Offsetting Scheme totalling a minimum of 1.64 biodiversity units has been submitted to and agreed in writing by the Local Planning Authority.
The written approval of the Council shall not be issued before the certificate has been issued by the Offset Provider. The details of biodiversity enhancements shall be documented by the Offset Provider and issued to the Council for their records.
Reason: To compensate for the net loss of biodiversity resulting from the development by providing biodiversity enhancements off site in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of development on the relevant phase (plots 1 to 6 and plots 7 and 8), a full surface water drainage scheme relevant to that phase, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and will be implemented in accordance with the approved details prior to the first occupation any dwelling in the relevant phase hereby approved.
Reason: To prevent pollution and flooding in accordance with Policies ENV12 and EP4 of the South Oxfordshire Local Plan 2035.
That, prior to the commencement of development on the relevant phase (plots 1 to 6 and plots 7 and 8), a full foul water drainage scheme relevant to that phase shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The development shall be carried out in accordance with the approved details prior to the first occupation of the any dwelling in the relevant phase hereby approved.
Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
No development hereby permitted shall take place except in accordance with the terms and conditions of the Council's organisational licence (WML-OR27- 2020-1) and with the proposals detailed on plan Land off Abingdon Road, Dorchester-on-Thames: Impact Plan , dated 12th October 2020.
Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence WML-OR27- 2020-1, policy ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF
No development hereby permitted shall take place unless and until a certificate from the Delivery Partner (as set out in the District Licence WML-OR27-2020- 1), confirming that all necessary measures in regard to great crested newt compensation have been appropriately dealt with, has been submitted to and approved by the local planning authority and the local authority has provided authorisation for the development to proceed under the district newt licence.
The Delivery Partner certificate must be submitted to this planning authority for approval prior to the commencement of the development hereby approved.
Reason: In order to adequately compensate for negative impacts to great crested newts, in accordance with policy ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF.
No development hereby permitted shall take place except in accordance with Part 1 of the GCN Mitigation Principles, as set out in the District Licence WMLOR27-2020-1 and in addition in compliance with the following:
- Works which will affect likely newt hibernacula may only be undertaken during the active period for amphibians.
- Capture methods must be used at suitable habitat features prior to the commencement of the development (i.e. hand/destructive/night searches), which may include the use of temporary amphibian fencing, to prevent newts moving onto a development site from adjacent suitable habitat, installed for the period of the development (and removed upon completion of the development).
- Amphibian fencing and pitfall trapping must be undertaken at suitable habitats and features, prior to commencement of the development.
Reason: In order to adequately mitigate impacts on great crested newts, in accordance with policy ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF.
Prior to the commencement of any site works or operations, including demolition and site clearance relating to the development hereby permitted on the relevant phase (plots 1 to 6 and plots 7 and 8), an Arboricultural Method Statement and accompanying Tree Protection Plan for the relevant phase shall be submitted to and approved in writing by the Local Planning Authority.
The Arboricultural Method Statement must include the following:
(1) A specification of any pruning or tree surgery works to any trees to be retained, to prevent accidental damage by construction or demolition activities;
(2) The specification and location of temporary tree protective fencing and any ground protection required to protect all retained trees in accordance with the current edition of BS 5837 ''Trees in relation to design, demolition and construction'', and details of the timing and duration of its erection;
(3) The definition of areas for the storage or stockpiling of materials, temporary on-site parking, site offices and huts, mixing of cement or concrete, and fuel storage;
(4) The means of demolition of any existing site structures, and of the re-instatement of the area currently occupied thereby;
(5) The route and method of installation of drainage or any underground services in the vicinity of retained trees; Consideration will be made to avoid siting of utilities and service runs within the Root Protection Area (RPA) of all trees to be retained. Only where it can be demonstrated that there is no alternative location for the laying of utilities, will encroachment into the RPA be considered. Methodology for any installation works within the RPA will be provided and must be in compliance with the current edition of NJUG 'Guidelines for the planning and installation and maintenance of utility apparatus in proximity to trees'.
(6) The details and method of construction of any other structures such as boundary walls in the RPA of retained trees and how these relate to existing ground levels;
(7) The details of materials and method of construction of any roadway, driveway, parking, pathway or other surfacing within the RPA, which is to be of a 'No Dig' construction method, in accordance with the principles with in Arboricultural Association Guidance Note 12. The use of cellular confinement systems near trees, and in accordance with current industry best practice; and is appropriate for the type of roadway required in relation to its usage.
(8) Provision for the supervision of ANY works within the RPA of trees to be retained, and for the monitoring of continuing compliance with the protective measures specified, by an appropriately qualified arboricultural consultant, to be appointed at the developer's expense and notified to the Local Planning Authority, prior to the commencement of development; and provision for the regular reporting of continued compliance or any departure there from to the Local Planning Authority.
Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
A Construction Traffic Management Plan (CTMP) relevant to the phase (plots 1 to 6 or plots 7 and 8) shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on the relevant phase. The approved CTMP shall be implemented prior to any works being carried out on the relevant phase, and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development on the relevant phase (plots 1 to 6 or plots 7 and 8) a phased risk assessment for the relevant phase of the site shall be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 'Investigation of potentially contaminated sites'. Each risk assessment phase shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. In this case, Phase 3 is required:
Phase 3 requires that a remediation strategy be submitted to and approved by the LPA to ensure the site will be rendered suitable for its proposed use.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development above slab level on the relevant phase (plots 1 to 6 or plots 7 and 8) hereby approved, a photographic schedule of all materials to be used in the external construction and finishes of the relevant phase hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Sustainable design features shall be incorporated into the construction and fittings of the dwellings hereby approved, details of which, including plans where necessary, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on the relevant phase (plots 1 to 6 or plots 7 and 8) above foundation slab level. The sustainable design features shall include measures set out in paragraph 5.4 of the submitted Design and Access Statement, Rev A, dated July 2020, by TSH Architects. The sustainable design features shall be implemented prior to occupation of any dwelling on the relevant phase and thereafter be retained.
Reason: To ensure high standards of sustainable design and construction, and limit carbon emissions in accordance policies DES8 and DES10 of the South Oxfordshire Local Plan 2035.
Plots 1 - 6 shall not be occupied until any previously approved remediation strategy relevant to Plots 1 to 6 has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority. Plots 7 and 8 shall not be occupied until any previously approved remediation strategy relevant to Plots 7 and 8 has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of Plots 1 to 6, the soft and hard landscaping schemes as shown on the approved plans 0787.1.1 B and 0787.1.2 B relevant to Plots 1 to 6 shall be implemented. Prior to the first occupation of Plots 7 and 8, the soft and hard landscaping schemes as shown on the approved plans 0787.1.1 B and 0787.1.2 B relevant to Plots 7 and 8 shall be implemented. Thereafter all shall be maintained in accordance with the approved scheme and Landscape Management Plan by Adams Habermehl, Rev A, dated 07.08.2020 . In the event of any of the soft landscaping so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, replacement planting, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Prior to first occupation of Plots 7 and 8, the proposed means of access onto Plots 7 and 8 shall be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to occupation of Plots 1 to 6, the existing means of access onto Plots 1 to 6 shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of Plots 1 to 6 , the parking and turning areas that serve those plots shall be provided in accordance with the approved plan 2018034-A-P-00-002 Rev G and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of Plots 7 to 8, the parking and turning areas that serve those plots shall be provided in accordance with the approved plan 2018034-A-P-00-002 Rev G and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with all of the recommendations made in section 5 and appendices C and D of the supporting Further Ecological Surveys Report (Abricon Ltd, 25/11/2020, Project Number: 001AYER100). The mitigation and enhancement measures set out in appendix C shall be implemented prior to occupation of the development.
Reason: To protect the important species on the site and to minimise the impacts of development on biodiversity, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.
The garage accommodation on plots 7 and 8 hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
