Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 15961-4-R1, 15961-6-R1, CH-10C, 15961-5-R1, CH-11D, LOC-001, CH02-a, 1017-01-12-04, 1017-02-12-04, CH-12E and CH-13G, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The materials to be used in the external finishes of the development hereby permitted shall be as agreed under applications P13/S0403/DIS & P13/S0963/DIS, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policies D1 and H12 of the South Oxfordshire Local Plan 2011 and to Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (no 2) Order 2008 (or any order revoking or re-enacting that Order), no extensions to the dwelling or garden buildings shall be erected on the land without the prior grant of planning permission from the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory and to safeguard the character of the area in accordance with Policies H12 and D1 of the South Oxfordshire Local Plan 2011 and to Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy.
That the sustainable design features specified in the application shall be incorporated into the construction and fittings of the dwelling and shall be retained as such.
Reason: To ensure high standards in the efficient use of energy, water and materials in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy 2027.
The landscaping of the development hereby permitted shall be as agreed under applications P13/S0403/DIS & P13/S0963/DIS, unless otherwise agreed in writing by the Local Planning Authority.The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011 and to Policy CSEN1 of the South Oxfordshire Core Strategy.
The tree protection measures as agreed under applications P13/S0403/DIS & P13/S0963/DIS shall be kept in place during the entire construction period, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011 and to Policy CSEN1 of the South Oxfordshire Core Strategy.
The development hereby permitted shall be implemented in accordance with the agreed scheme of mitigation under applications P13/S0403/DIS & P13/S0963/DIS. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. This condition will be discharged on receipt of a letter from the project ecologist providing evidence to demonstrate that the mitigation has been completed according to the approved report.
Reason: To protect the important species on the site, in accordance with Policy C8 of the South Oxfordshire Local Plan 2011.
That the outbuildings hereby permitted shall be occupied and used only for purposes incidental to the occupation and use of the new dwelling hereby permitted, and shall not be occupied or used separately therefrom.
Reason: Permission is granted on the basis that the use will be incidental to the main house, as unrelated use would be contrary to Policies H6 and H13 of the South Oxfordshire Local Plan 2011 and to Policy CSR1 of the South Oxfordshire Core Strategy.
That prior to the first occupation of the dwelling hereby permitted, all of the existing dwelling and the existing farm buildings shall be demolished and all materials shall be removed from the site.
Reason: To ensure that the details of the development are satisfactory and to safeguard the character of the area in accordance with Policies H12 and D1 of the South Oxfordshire Local Plan 2011 and to Policy CSEN1 of the Draft South Oxfordshire Core Strategy.
The spoil shall be disposed of in accordance with the details approved under applications P13/S0403/DIS & P13/S0963/DIS prior to the first occupation of the dwelling, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory and to safeguard the character of the area in accordance with Policies H12 and D1 of the South Oxfordshire Local Plan 2011 and to Policy CSEN1 of the Draft South Oxfordshire Core Strategy.
