Conditions / Refusal Reasons
The development shall be carried out solely in accordance with details submitted with the application unless modified by the conditions of this permission. The details submitted consist of Application Form dated 04/06/10; Planning Supporting Statement dated May 2010, Design and Access Statement dated May 2010; Site Location Plan - Drawing no. J9014-AD10.001-P100 rev0 dated May 2010; Existing site and Overview - Drawing no. J9014-10.001-P200 rev0 dated May 2010; Site Layout - Drawing no. J9014-AD10.001-P300 rev 0 dated May 2010; Elevations - Drawing no. J9014-AD10.001-P400 rev0 dated May 2010; Traffic Management Plan - Drawing no. J9014-AD10.001-P500 rev0 dated May 2010; Landscape and Visual Appraisal dated 02/07/10; Ecological Study dated 05/05/10 and Flood Risk Assessment dated May 2010.
Reason: To ensure the development is carried out as proposed.

The development to which this permission relates shall be begun not later than the expiration of five years beginning with the date of this permission.
Reason: To comply with Section 91 to 95 of the Town & Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

No operations, including HGVs entering and leaving the site, other than water pumping or environmental monitoring, shall be carried out at the site except between the following times:
(a) 0700 and 1800 hours Monday to Friday and 0700 and 1600 hours Saturdays;
(b) 0800 and 1400 hours on Sundays and Public or Bank Holidays.
Reason: To protect the amenities of nearby properties.
Policy: OMWLP PE18
No waste other than organic waste shall be imported to the site.
Reason: To enable the Waste Planning Authority to retain control over the development.

Fertiliser produced from the Anaerobic Digestion (AD) process shall be used on fields of nearby surrounding farms only.
Reason: To enable the Waste Planning Authority to retain control over the development.

No floodlighting shall be erected on site except in accordance with a scheme which shall be submitted to and approved in writing by the Waste Planning Authority. Floodlighting shall not operate except during the hours permitted in condition 3.
Reason: In the interests of the amenities of nearby residents.

No development shall take place except in accordance with the approved landscaping scheme as specified in Drawing no. 0853.3 Indicative Planting.
Reason: To reduce the visual impact on the open countryside and to screen the workings and to assist in absorbing the site back into the local landscape.

The existing trees, bushes and hedgerows within the site, as shown on Drawing no. 0853.3 Indicative Planting shall be retained and shall not be felled or removed in areas outside the current or succeeding phase of development.
Reason: To ensure that flora is protected from the effects of development and the development does not result in a loss of biodiversity.

Existing trees, shrubs and hedgerows and those planted in accordance with Drawing no. 0853.3 Indicative Planting shall be maintained to enhance biodiversity and to provide an effective visual screen between the works and properties/the highway and any plants which die at any time during the development, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species.
Reason: To improve the appearance of the site in the interests of visual amenity, to screen the workings, and to assist in absorbing the site back into the local landscape.

No vegetation shall be cleared from the land except between 1st September and 28th February (inclusive) as this is outside of the bird breeding season. Any vegetation to be cleared between 1st March and 31st August (inclusive) must be checked by an ecologist immediately before being cleared so as to ensure there are no nesting birds present. If nesting birds are present, the area of vegetation must be cordoned off and works cannot be carried out until the birds have fledged.
Reason: To ensure nesting birds are protected from disturbance.

Six Schweglar 1B (32mm hole) bird boxes shall be installed on suitable trees on the southwestern boundary of the site during the first planting season following completion of the development hereby approved.
Reason: To ensure the development results in biodiversity enhancement.

The existing sign erected at the access informing drivers of the routes that they should use in entering and leaving the site shall be retained for the life of the permission.
Reason: In the interests of highway safety and safeguarding the local environment.

No development shall commence until a Travel Plan has been submitted to and approved in writing by the Waste Planning Authority. This Travel Plan shall cover Construction Traffic and use of sustainable modes of transport.
Reason: In the interest of highway safety.

Prior to the commencement of the development, the parking and turning areas shall be provided in accordance with the submitted plan Drawing J9014-AD10.001-P500 rev 0, and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interest of highway safety.
Policy: OMWLP W3, SOLP T1
No development shall take place on the site until a scheme for redesign of the proposed access onto the A4074 has been submitted and approved by the Waste Planning Authority. Any scheme approved shall be implemented in full before the development hereby approved is brought into use.
Reason: In the interest of highway safety and to discourage right turns to and from the A4074.

No agrivert owned or rented plant, machinery or vehicles shall be used on the site unless fitted with effective silencers.
Reason: To safeguard the amenity of the area and local residents.

The surface of the site access shall be maintained in a good state of repair and kept clean and free from mud and other debris at all times.
Reason: In the interests of highway safety and safeguarding the local environment.

No vehicle or trailer shall enter the public highway unless their wheels and chassis have been cleaned to prevent material being deposited on the highway.
Reason: In the interests of highway safety and to prevent mud and dust getting on the highway.
Policy SOLP T1
During dry weather a water bowser and other dust suppression measures as identified in the supporting statement should be used to reduce the amount of dust on the site.
Reason: In the interests of environmental amenity.
Policy: OMWLP W3, PE18, SOLP EP1
A soil bund shall be maintained around the perimeter of the site. The bund shall be maintained at more than 1 metre high at any point. The bund shall be seeded with rye grass mix and shall be kept free of weeds and the grass shall be cut regularly. The bund shall be constructed so that the outside of the bund should be at an angle of 30 degrees to the horizontal. The bund shall be rounded at the top and feathered into ground level so that there is no sharp angle. The top of the bund shall be granted to an even height of more than 1 metre high. The development shall not commence until the bund has been constructed in accordance with this condition.
Reason: To mitigate noise and dust and in the interest of local and visual amenity.

No agrivert owned or rented vehicles or mobile plant operating on this site shall emit warning noise except in the form of white noise.
Reason: To protect the amentiy of local residents.

In the event that there are complaints about noise from this site that the Waste Planning Authority considers to be justified, then a noise control scheme shall be submitted within one month of the Waste Planning Authority notifying the operator in writing that nuisance has occurred and that a scheme is necessary. Any scheme approved in writing by the Waste Planning Authority shall be implemented immediately.
Reason: In the interests of the amenity of nearby residents.

Samples of the exterior materials proposed to be used for the reception building, wood chip building and tanks as shown on approved plan J9014-AD10.001-P300 rev0 shall be submitted to and approved in writing by the Waste Planning Authority prior to the start of construction of the proposed buildings. No development shall take place except in accordance with these approved materials.
Reason: In the interests of visual amenity.
Policy: OMWLP W3
Prior to the commencement of development full design details of the gas flares shall be submitted for the written approval of the Waste Planning Authority. No gas flares shall be erected except in accordance with the approved details.
Reason: To safeguard the amenity of the area and local residents.
Policy: OMWLP W3
Prior to the commencement of development full design details and elevations of the gas engine building shall be submitted for the written approval of the Waste Planning Authority. The gas engine building shall not be erected except in accordance with the approved details.
Reason: In the interests of visual amenity.
Policy: OMWLP W3
An archaeological watching brief shall be carried out during the period of construction/during any ground works taking place on the site. The watching brief shall be carried out by a professional archaeological organisation in accordance with a Written Scheme of Investigation that has first been approved by the Waste Planning Authority.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site.

Following the approval of the Written Scheme of Investigation referred to in Condition 26, no development shall commence on site without the appointed archaeologist being present. Once the watching brief has been completed its findings shall be reported to the Waste Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site.

Development shall be carried out in accordance with the following mitigation measures detailed within the approved Flood Risk Assessment (FRA) produced by Consultant Hydrogeologists Limited dated May 2010 titled Proposed Anaerobic Digestion and Composing Facility Battle Farm, Crowmarsh, Oxfordshire, reference number B/CRW001/10.
- Limiting the surface water run-off to 3.6l/s/ha for the 1 year event, 9.8l/s/ha for the 30 year event and 13.7l/s/ha for the 100 year event.
- Provision of attenuation as stated in approved FRA (included drawing 5 - proposed site layout):
-for the storage/digestion tanks an attenuation of volume of 295m3 will be provided through the proposal of a swale at the western section of the site.
For access roads an attenuation volume of 638m3 will be required through the inclusion of swales located on the southern section of the site.
- rainwater will be retained within the site for the new compost area and energy crop area and will be used within the digestion process
- roof water from the reception building will be collected and used within the AD process.
Reason: To ensure flood risk is not increased off-site and to prevent flooding elsewhere by ensuring that attenuation of rainfall for the 1 in 100 year plus 20% climate change.

No development shall take place until such time as a scheme to dispose of surface and foul drainage has been submitted to, and approved in writing by the Waste Planning Authority. The scheme shall be implemented as approved.
Reason: To protect the groundwater quality from the activities of the Anaerobic Digestion (AD) facility.

In the event that there are complaints about offensive odours from this site that the Waste Planning Authority considers to be justified, then an odour control scheme shall be submitted within one month of the Waste Planning Authority notifying the operator in writing that nuisance has occurred and that a scheme is necessary.
