Conditions / Refusal Reasons
That the development to which this permission relates shall be begun not later than whichever is the later of the following dates: (a) the expiration of three years from the date of this permission; or (b) the expiration of two years from the final approval of the reserved matters, or in the case of approval on different dates, the final approval of the last such matter to be approved. Reason: By virtue of Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the local planning authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not commence until foul drainage works have been carried out in accordance with details that have been submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not be begun until full detailed drawings illustrating the following matters have been submitted to and approved in writing by the Local Planning Authority and the development shall be carried out in accordance with such details: (i) the appearance of the new development; (ii) the access to the new development; and Reason: As the application is in outline only and is not accompanied by detailed plans and by virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Sustainable design features shall be incorporated into the construction and fittings of the building, details of which shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the building. The sustainable design features shall be provided in accordance with the submitted details and retained as such. Reason: To ensure high standards in the conservation and efficient use of energy in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no window(s), door(s) or other openings shall be inserted at any time in the first floor side (north/south) elevations of the development hereby approved. Reason: To safeguard the amenities of the occupiers of adjoining properties in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.

The dwelling hereby permitted shall be two storeys only and the ridge height shall not exceed 7.5 metres. Reason: To ensure that the character of the street is retained in accordance with Policies G6 and D1 of the South Oxfordshire Local Plan 2011.

Development shall not commence on site until written approval has been granted by the Local Planning Authority to plans detailing the slab level of the building hereby permitted relative to existing ground level, and the development shall only proceed strictly in accordance with the details so approved. Reason : To ensure that the development is not unneighbourly or intrusive in accordance with Policies G2, D1, D4 and H4 of the South Oxfordshire Local Plan 2011.
