Demolition of existing 3 No dwellings and erection of six two bedroom flats, one three bedroom dwelling and two one bedroom flats(as amended by drawing nos. 302, 303, 304, 305, 306, 307 and 308 accompnying letter from Agent dated 8 April 2008 and drawing no.301B accompanying letter from Agent dated 24 April 2008 and clarified by Arboricultural Report dated 2 May 2008)
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policies G2, G6, C1, D1, and H4 of the South Oxfordshire Local Plan 2011.
No development or other operations shall commence on site until details of a tree and landscape protection scheme in accordance with BS5837:2005 (Trees in Relation to Construction) have been submitted to and approved in writing by the Local Planning Authority. The scheme shall include positions and specifications of temporary fencing to be erected and no excavations for services, storage of materials, parking of vehicles, excavation of soils or materials shall take place within the area designated as being protected. The approved tree and landscape protection scheme shall be carried out concurrently with the development of the site.
Reason: To ensure the protection of trees on and adjacent to the site in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.
No development or other operations shall commence on site until a scheme for the landscaping of the site, including details of hardsurfacing and fencing or other means of enclosure, has been submitted to and approved in writing by the Local Planning Authority. The details shall include schedules of plants, noting species, plant sizes and proposed numbers/densities, an implementation programme, and details of written specifications including cultivation and other operations involving tree, shrub and grass establishment. The scheme shall ensure:
a)Completion of the approved landscape scheme within the first planting season following the completion of the development.
b)Any trees, shrubs or plants that die or become seriously damaged within five years of the commencement of the development shall be replaced by trees or shrubs of similar size and species to those originally required to be planted.
Reason: To ensure the implementation of a satisfactory scheme of landscaping which will in due course improve the quality of the development in accordance with Policies G2, G6, C1, D1 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development details of any external lighting to be used in the areas around the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority. Thereafter no building shall be occupied until the external lighting has been installed in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C1, D1 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site relative to adjoining land, together with the slab levels and ridge heights of the proposed buildings, shall be submitted to, and approved in writing by the Local Planning Authority.
Reason: To ensure that the development properly relates to the levels of adjoining development in the interests of amenity and in accordance with Policies G2, G6, C1, D1, and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), no additions or extensions to the dwelling indicated as Unit 1 on the approved drawings shall be built or ancillary buildings or structures erected within the curtilage, unless permission has been granted by the Local Planning Authority on an application made for the purpose.
Reason: To prevent the overdevelopment of the site in accordance with Policies G2, G6, C1, D1 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan 08.225.301 B and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles associated with the development hereby approved at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Prior to occupation of the development hereby permitted the proposed means of access onto Reading Road is to be formed and laid out to the approval of the Local Planning Authority, constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Before the proposed access is first used, the existing access onto Reading Road shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development, full details of the cycle parking facilities shall be submitted to and approved in writing by the Local Planning Authority and thereafter shall be provided and retained in accordance with the approved details prior to the first occupation of the development and thereafter retained.
Reason: To encourage bicycle use in accordance with Policy T2 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be designed and constructed to meet Code Level 3 of the Code for Sustainable Homes. A post construction review of the development in relation to the Code for Sustainable Homes shall be submitted to the Local Planning Authority prior to the occupation of the development.
Reason: To ensure high standards in the conservation and efficient use of energy, water and materials in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall not be occupied until surface water drainage works have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1 and EP6 of the South Oxfordshire Local Plan 2011.
Full details of the household waste and recycling collection point shall be submitted to and approved in writing prior to the commencement of development. Thereafter the development shall be carried out in accordance with the approved details.
Reason: In the interests of the visual appearance of the development and waste management in accordance with Policies G2, G6, C1, D1, D10 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development details of the fire hydrants to be provided shall be submitted to and approved in writing by the Local Planning Authority and the hydrants shall be provided in accordance with the approved details prior to the first occupation of development.
Reason: In the interests of fire safety in accordance with Policy D11 of the South Oxfordshire Local Plan 2011.
